CONDITIONS

This Equivalency Certificate authorizes CDN Energy and Power Corp. to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods that are UN3480, LITHIUM ION BATTERIES, Class 9, Packing Group II, in a manner that does not comply with subsection 5.1(1) and section 5.14 of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) each cell and battery have been determined to meet the criteria for assignment to Class 9 on the basis of tests carried out in accordance with the Recommendations on the Transport of Dangerous Goods - Manual of Tests and Criteria, Part III, subsection 38.3;

(b) each cell or battery incorporates a safety venting device or is designed to preclude a violent rupture under normal conditions of transport;

(c) each battery containing cells or series of cells connected in parallel is equipped with effective means as necessary to prevent dangerous reverse current flow (e.g., diodes, fuses, etc.);

(d) the rated energy capacity of each battery module within a battery assembly does not exceed 4 kWh;

CONDITIONS

(e) the maximum rated energy capacity of the battery assembly does not exceed 2.0 MWh;

(f) the battery modules are loaded and secured in trays and placed inside a rack system which is secured to the ISO-standard freight container. The ISO-standard freight container serves as a strong outer packaging;

(g) the racks are bolted to the ISO-standard freight containerat both the floor and wall structure as to prevent damage, short circuits, and inadvertent movement so that under normal conditions of transport, including handling, there will be no release of the dangerous goods that could endanger public safety;

(h) the battery assembly is equipped with a battery management system (BMS) capable of monitoring the battery assembly and preventing short circuits, or over discharge between the batteries in the assembly or any overheat or overcharge of the battery assembly;

(i) the battery terminals do not support the weight of other superimposed elements;

(j) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 11816"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the certificate holder to transport dangerous goods that are UN3480, LITHIUM ION BATTERIES (including lithium ion polymer batteries), Class 9, in a manner that does not comply with section 5.14 of the TDG Regulations. The dangerous goods are transported in trays that are placed inside a rack system that is permanently fixed to the ISO-standard freight container.

Each ISO-standard freight container is also equipped with a smoke detection system (Kidde Fire Protection System) and an evaporative chiller. The fire extinguishing agent (UN1956, COMPRESSED GASES, N.O.S. (C-6 Perfluoroketone), Class 2.2, in the Kidde system is contained in TC-4BWM34 cylinders, which are authorized by CSA Standard B340-08, "Selection and use of cylinders, spheres, tubes, and other containers for the transportation of dangerous goods, Class 2", March 2008. The refrigerating machine (UN2857, REFRIGERATING MACHINES containing non-flammable, non-toxic, gases, Class 2.2), contains less than 5 kg of R410a refrigerant gas and complies with standard CSA B52, "Mechanical Refrigeration Code" as required by clause 6.2 of CSA Standard B340-08, "Selection and use of cylinders, spheres, tubes, and other containers for the transportation of dangerous goods, Class 2", March 2008.
