CONDITIONS

This Equivalency Certificate authorizes Best Buy Canada Ltd., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road vehicle, dangerous goods that are:

  • UN3090, LITHIUM METAL BATTERIES, Class 9,
  • UN3091, LITHIUM METAL BATTERIES CONTAINED IN EQUIPMENT or LITHIUM METAL BATTERIES PACKED WITH EQUIPMENT, Class 9,
  • UN3480, LITHIUM ION BATTERIES, Class 9,
  • UN3481, LITHIUM ION BATTERIES CONTAINED IN EQUIPMENT or LITHIUM ION BATTERIES PACKED WITH EQUIPMENT, Class 9,

in a manner that does not comply with subsections 34(4) and 34(5) of special provision 34 of Schedule 2 of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the dangerous goods are handled, offered for transport or transported in compliance with subsections 34(1), 34(2), and 34(3) of special provision 34 of Schedule 2 the Transportation of Dangerous Goods Regulations;

CONDITIONS

(b) the dangerous goods are transported by road solely between Best Buy Canada's facilities. A list of Best Buy Canada's facilities may be obtained by contacting the Approvals Division by e-mail at tdgapprovals-approbationstmd@tc.gc.ca;

(c) the dangerous goods are in small means of containment designed, constructed, filled, closed, secured, and maintained so that under normal conditions of transport, including handling, there will be no accidental release of the dangerous goods that could endanger public safety;

(d) the small means of containment are placed on a pallet and secured with shrink wrap;

(e) the overpack is not intended to be opened during transport;

(f) the overpack is marked durably and legibly on two opposite sides with the following:

(i) "lithium metal", "lithium métal", "lithium ion" or "lithium ionique", as appropriate,

(ii) an indication that the means of containment must be handled with care and that a flammability hazard exists if the means of containment is damaged,

(iii)an indication that special procedures must be followed in the event the means of containment is damaged, including inspection and repacking, if necessary,

(iv)a telephone number to call for additional information,

(v) the Equivalency Certificate number "SH 11796", and

(vi)the word "Overpack" or "Suremballage";

CONDITIONS

(g) each overpack must be accompanied by a document that includes the information marked on the overpack in accordance with conditions (f)(i), (ii), (iii), (iv), and (v) of this Equivalency Certificate;

(h) the certificate holder must ensure that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(i) a paper or electronic copy of this Equivalency Certificate is carried on board the means of transport used to transport the dangerous goods.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

Best Buy Canada's facilities across Canada move inventory from one facility to another to ensure required inventory balancing so that there is on-hand inventory at its facilities at all times. The dangerous goods are transported in consolidated shipments of a number of individual means of containment, generally rigid plastic totes, within a palletized shrink-wrapped overpack. The overpack is moved from one facility directly to another by contract carrier without addition or removal of the individual means of containment. This Equivalency Certificate authorizes the labelling of the overpack instead of each individual means of containment. Each overpack must also be accompanied by a document that includes the labelling information.
