CONDITIONS

This Equivalency Certificate authorizes Grin Technologies Ltd., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods that are UN3480, LITHIUM ION BATTERIES (including lithium ion polymer batteries), Class 9, in a manner that does not comply with special provision 123 of Schedule 2 of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) each cell has been determined to meet the criteria for assignment to Class 9 on the basis of tests carried out in accordance with the Recommendations on the Transport of Dangerous Goods - Manual of Tests and Criteria, Part III, subsection 38.3;

(b) each battery or battery assembly has not been tested in accordance with the Recommendations on the Transport of Dangerous Goods - Manual of Tests and Criteria, Part III, subsection 38.3, and therefore, do not meet the inclusion criteria for Class 9;

CONDITIONS

(c) the dangerous goods are:

(i) production runs consisting of not more than 100 lithium cells or batteries, or

(ii) pre-production prototypes of cells or batteries;

(d) the pre-production prototypes of cells or batteries are in transport for the purpose of testing;

(e) each cell or battery incorporates a safety venting device or is designed to preclude a violent rupture under normal conditions of transport;

(f) each cell or battery is equipped with an effective means of preventing external short circuits;

(g) each battery containing cells or series of cells connected in parallel is equipped with effective means as necessary to prevent dangerous reverse current flow (e.g. diodes, fuses, etc.);

(h) each cell or battery is individually packed in an inner means of containment inside an outer means of containment and is surrounded by cushioning material that is non-combustible and non-conductive;

(i) the outer means of containment is a UN Standardized means of containment, that meets the criteria for Packing Group I means of containment in accordance with Chapter 6.1 of the UN Recommendations on the transport of dangerous goods - Model Regulations;

(j) batteries that have a total mass of 12 kg or more and that have a strong, impact-resistant outer casing or assemblies of them, may be packed in an outer means of containment or protective enclosure designed, constructed, filled, closed, secured, and maintained so that under normal conditions of transport, including handling, there will be no release of the dangerous goods that could endanger public safety. The batteries or battery assemblies must be protected from short-circuit;

(k) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

CONDITIONS

(l) a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods;

(m) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 11794"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the transportation of prototype or production run batteries that have not been fully tested. The batteries are classified as UN3480, LITHIUM ION BATTERIES (including lithium ion polymer batteries), Class 9.

The conditions of this certificate reflect the requirements outlined in special provision 123 of the Transportation of Dangerous Goods Regulations, except that the dangerous goods may be transported in a UN standardized cardboard box, that meets the criteria for Packing Group I means of containment in accordance with Chapter 6.1 of the UN Recommendations. A UN standardized cardboard box (4G) is currently authorized in the UN Recommendations on the transport of dangerous goods - Model Regulations, 19th Edition.
