CONDITIONS

This Equivalency Certificate authorizes Call2Recycle Canada, the participants in the program Call2Recycle or the consumers participating in battery recalls to handle, offer for transport or transport and authorizes any person to handle or transport on behalf of Call2Recycle Canada, the participants in the program Call2Recycle or the consumers participating in battery recalls by road or railway vehicle, or by ship, dangerous goods that are:

  • UN3090, LITHIUM METAL BATTERIES (including lithium alloy batteries), Class 9,
  • UN3091, LITHIUM METAL BATTERIES CONTAINED IN EQUIPMENT, (including lithium alloy batteries), Class 9,
  • UN3480, LITHIUM ION BATTERIES (including lithium ion polymer batteries), Class 9, or
  • UN3481, LITHIUM ION BATTERIES CONTAINED IN EQUIPMENT (including lithium ion polymer batteries), Class 9,

in a manner that does not comply with Part 3 (Documentation), Part 4 (Dangerous Goods Safety Marks), and Part 6 (Training) of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the cells or batteries are damaged or defective and do not conform to subsection 2.43.1(2) of Part 2 (Classification) of the Transportation of Dangerous Goods Regulations;

CONDITIONS

(b) the cells and batteries are transported in accordance with the requirements of Special Provision 137 of Schedule 2 of the Transportation of Dangerous Goods Regulations;

(c) no more than 2 kg (net weight) of lithium cells and batteries may be contained in a single outer means of containment. However, a single cell or battery may be shipped within one (1) outer means of containment provided the cell or battery has a net mass of 5 kg or less;

(d) the outer means of containment is durably and legibly marked on a contrasting background with either the label No. 9A prescribed in section 5.2.2.2.2 of the UN Recommendations on the Transport of Dangerous Goods, 19th revised edition, or the handling marking prescribed in § 173.185(c)(4)(i) of the US DOT 49 CFR - Code of Federal Regulations;

(e) despite Special Provision 137(4) of Schedule 2 of the Transportation of Dangerous Goods Regulations, the words "Damaged/defective lithium metal battery" or "Damaged/defective lithium ion battery", as appropriate, may be durably and legibly marked on a contrasting background on the outer means of containment;

(f) detailed closure, packing and shipping instructions are provided to individuals preparing shipments under the conditions of this Equivalency Certificate;

(g) the outer means of containment is durably and legibly marked on a contrasting background with the Equivalency Certificate number "SU 11777".

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes Call2Recycle Canada, the participants in the program Call2Recycle or the consumers participating in battery recalls to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of Call2Recycle Canada, the participants in the program Call2Recycle or the consumers participating in battery recalls; dangerous goods that are lithium metal cells, or batteries, or lithium-ion cells, or batteries in a manner that does not comply with Part 3 (Documentation), Part 4 (Dangerous Goods Safety Marks) and Part 6 (Training) of the Transportation of Dangerous Goods Regulations. This Equivalency Certificate may be needed to conduct a recall of a lithium metal, or lithium-ion battery, or a consumer product containing a lithium metal, or lithium‑ion battery. The cells or batteries are either damaged or defective.
