CONDITIONS

This Equivalency Certificate authorizes Cryopeak LNG Solutions Corporationto handle, offer for transport or transport by road vehicle, dangerous good that are UN1972, METHANE, REFRIGERATED LIQUID or NATURAL GAS, REFRIGERATED LIQUID with high methane content, Class 2.1, in a manner that does not comply with subparagraph 5.10(1)(a)(ii) of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the means of containment are non-specification vacuum-insulated containers maintained at atmospheric pressure by continuous venting of the refrigerated liquefied gas;

(b) the containers have a maximum water capacity of 10 L and are manufactured and designed in accordance with the specifications filed by Cryopeak LNG Solutions Corporation with the Executive Director, Regulatory Affairs Branch, Transportation of Dangerous Goods Directorate, Transport Canada;

(c) the openings of the containers are fitted with lids allowing gas to escape but preventing splashing out of the refrigerated liquefied gas and so configured that the lids remain in place during transport;

(d) the containers are designed, manufactured, and equipped taking into consideration the conditions to which they will be subjected as part of their intended use under normal conditions of transport;

CONDITIONS

(e) the materials of construction of the containers have suitable mechanical properties at the service temperature;

(f) the containers are transported for demonstration and training purposes only;

(g) neither the containers nor the refrigerated liquefied gas are for sale;

(h) the containers are filled at a facility nearest to the training site and are transported along the shortest route from the filling facility to the site where the demonstration and training is performed;

(i) the containers are filled in the vertical position;

(j) when filled with refrigerated liquefied gas, the containers remain outdoors at all times;

(k) each container are secured in the vertical position within a transport box that is manufactured and designed in accordance with drawing number 6.55.001.GA.001 Rev. A filed by Cryopeak LNG Solutions Corporation with the Executive Director, Regulatory Affairs Branch, Transportation of Dangerous Goods Directorate, Transport Canada;

(l) openings in the top of the transport box allow venting such that gas does not accumulate in the box;

(m) non-combustible packaging is placed between the container and the transport box to prevent the container from moving laterally within the transport box;

(n) the container is fitted within the transport box such that the container lid remains in position if the transport box is overturned;

(o) the container and the transport box are transported in the open cargo space of a road vehicle and the transport box is secured to the road vehicle to prevent shifting and overturning;

(p) the road vehicle used to transport the containers complies with Clause 4.1.3 of CSA B340-14, "Selection and use of cylinders, spheres, tubes, and other containers for the transportation of dangerous goods, Class 2", January 2014;

(q) the containers are emptied at the site where the demonstration and training is performed before being transported again;

CONDITIONS

(r) transportation of the containers in accordance with this Equivalency Certificate occurs no more than 20 times per year;

(s) the Equivalency Certificate holder reports any incident involving loss of contents or failure of the containers to the Executive Director, Regulatory Affairs Branch, Transportation of Dangerous Goods Directorate, Transport Canada;

(t) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the Equivalency Certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(u) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SH 11729"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the transportation of a refrigerated liquefied gas using a non-specification vacuum-insulated container maintained at atmospheric pressure by continuous venting in a manner that does not comply with Part 5 (Means of Containment) of the Transportation of Dangerous Goods Regulations.
