CONDITIONS

This Equivalency Certificate authorizes Seastar Chemicals Inc., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by ship on a domestic or international voyage, dangerous goods that are UN1873, PERCHLORIC ACID with more than 50% but not more than 72% acid, by mass, Class 5.1(8), Packing Group I, in a manner that does not comply with special packing provision PP28 of packing instruction P502 of Chapter 4.1 of Part 4 of the International Maritime Dangerous Goods Code, incorporated by reference in subsection 11.1(1) of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the dangerous goods are packaged following the requirements of packing instruction P502 of chapter 4.1 of part 4 of the International Maritime Dangerous Goods Code;

(b) despite special packing provision PP28 of packing instruction P502 of Chapter 4.1 of Part 4 of the International Maritime Dangerous Goods Code, the dangerous goods may be packaged in a combination packaging comprising of a plastic inner packaging;

(c) the inner packaging has a volume less than or equal to 2.5 litres;

CONDITIONS

(d) the requirements of paragraph 4.1.1.2 of chapter 4.1 of part 4 of the International Maritime Dangerous Goods Code are complied with;

(e) the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(f) a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods;

(g) the document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SM 11724 (Ren. 1)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulations not specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes Seastar Chemicals Inc., to package UN1873, PERCHLORIC ACID with more than 50% but not more than 72% acid, by mass, Class 5.1(8), Packing Group I, in a combination packaging comprising of a plastic inner packaging. The use of a plastic inner packaging is currently authorized in the Transportation of Dangerous Goods Regulations, US DOT 49 CFR as well as in the UN Recommendations on the transport of dangerous goods - Model Regulations.
