CONDITIONS

This Equivalency Certificate authorizes Rio Tinto Fer et Titane inc.,to load and unload, by railway vehicle, dangerous goods that are UN1402, CALCIUM CARBIDE, Class 4.3, Packing Group I, in a manner that does not comply with clause 10.6.2 c. of the of the Transport Canada Standard TP14877E, "Containers for Transport of Dangerous Goods by Rail, a Transport Canada Standard", December 2013, and incorporated by reference in subparagraph 5.14(1)(b)(ii) of the Transportation of Dangerous Goods Regulations regarding locked switches or locked derails, under the following conditions:

(a) the railway vehicles are loaded and unloaded in accordance with the company's procedure MTN TF-281, "Remplacement d'un wagon de CaC2 vide par un plein", July 2014;

(b) the means of containment are transported in accordance with Special Permit DOT-SP 14659 (Second Revision) issued by the U.S. Department of Transportation (DOT);

CONDITIONS

(c) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.
