CONDITIONS

This Equivalency Certificate authorizes:

1) CMV srl to design and manufacture a means of containment used or intended to be used in importing, offering for transport, handling, or transporting dangerous goods in a manner that does not comply with section 5.1 of the Transportation of Dangerous Goods Act, 1992,

2) any person to sell, offer for sale, deliver, distribute, import or use a standardized means of containment in a manner that does not comply with section 8 of the Transportation of Dangerous Goods Act, 1992; and

3) any person to handle, offer for transport, transport, or import, by road or railway vehicle, by aircraft or by ship on a domestic voyage, dangerous goods included in Class 2, Gases, in a means of containment in a manner that does not comply with sections 5.1 and 5.2, subparagraphs 5.10(1)(a)(iii), 5.10(1)(b)(iv), 5.10(1)(c)(iii), and 5.10(1)(d)(iv) of the Transportation of Dangerous Goods Regulations, in relation to the manufacture, selection, and use of means of containment only, if:

CONDITIONS

(a) subject to conditions (b) to (h) of this certificate, the requirements applicable to UN cylinders in standard CSA B342-09, "Selection and use of UN pressure receptacles and multiple-element gas containers for the transport of dangerous goods, Class 2", March 2009, cited in the rest of the certificate as CSA B342‑09, are complied with;

(b) despite the definition of a UN cylinder in Clause 3 of CSA B342-09, the cylinders have a water capacity exceeding 150 L;

(c) despite Clause 4.1.4 of CSA B342-09, the cylinders are not filled with a gas or gas mixture different from that previously contained unless the necessary operations for change of gas service have been performed. Change of service for compressed and liquefied gases is in accordance with ISO 11621. In addition, a cylinder that contained a Class 8 corrosive substance or a substance of another class with a corrosive subsidiary class is not authorized for the transport of a Class 2 substance unless the necessary inspections and tests specified in condition (k)(iii) of this certificate have been performed;

(d) despite Clause 4.1.7 of CSA B342-09, the cylinders, including their closures, comply with the design, construction, inspection, and testing requirements of condition (i) of this certificate. When outer packagings are prescribed in CSA B342-09, the cylinders are firmly secured within the outer packaging. Unless otherwise specified in Clause 5 of CSA B342-09, one or more inner packagings may be enclosed in an outer packaging;

(e) despite Clause 4.1.9 of CSA B342-09, the cylinders are periodically inspected and tested in accordance with condition (k)(iii) of this certificate. Cylinders are not be filled after they become due for periodic inspection and testing but may continue in use until empty and be transported after expiry of the time limit;

(f) despite Clause 4.1.10(b) of CSA B342-09, repairs are consistent with the fabrication and testing requirements of this certificate and only as permitted by condition (k)(iv) of this certificate;

(g) despite Clause 5.1.3(a) of CSA B342-09, the cylinders are manufactured in accordance with condition (i) of this certificate;

CONDITIONS

(h) despite Clause 5.1.4 of CSA B342-09, before being filled, cylinders due for periodic inspection and testing are subjected to a periodic inspection and test in accordance with the periodic inspection and test requirements of condition (k)(iii) of this certificate. Cylinders that do not meet the requirements of the prefill inspection are rejected and not filled until the cause of rejection has been corrected;

(i) subject to conditions (j) to (k)(iv) of this certificate, the cylinders are designed, constructed, initially inspected and tested, periodically inspected and tested, repaired, and marked in accordance with the requirements (including the Annexes) applicable to UN cylinders in CSA Standard B341-09, "UN pressure receptacles and multiple-element containers for the transport of dangerous goods", March 2009, cited in the rest of this certificate as CSA B341-09;

(j) the cylinders are manufactured by CMV srl at Via A. Volta, 15, Zané, VI 36010, Italy, in accordance with the specific procedures, the design qualification test reports, and drawing number AE007 Rev. 0, dated October 22, 2014, filed by CMV srl with the Director, Regulatory Affairs Branch, Transportation of Dangerous Goods, Transport Canada;

(k) the cylinders are designed, constructed, and initially inspected and tested in compliance with Clause 6 of CSA B341-09 and the requirements applicable to UN refillable seamless steel cylinders specified in ISO standard 9809-1, "Gas cylinders - Refillable seamless steel gas cylinders - Design, construction and testing - Part 1: Quenched and tempered steel cylinders with tensile strength less than 1100 MPa", cited in the rest of the certificate as ISO 9809-1:1999, except that;

(i) the requirement for the maximum water capacity of 150 L as specified in the definition of a UN cylinder in Clause 3 of CSA B341-09 and as specified in Clause 1 of ISO 9809-1:1999 does not apply and the water capacity of the cylinders is in accordance with the applicable cylinder design specified in condition (k) of this certificate;

(ii) the cylinders are marked in accordance with Clause 4.4 of CSA B341‑09, except that;

(A) the mark required by Clause 4.4.1.2.1(a) of CSA B341-09 is not applied,

(B) the mark required by Clause 4.4.1.2.1(b) of CSA B341-09 is replaced with "TC-SU 11704",

CONDITIONS

(iii)the cylinders are subjected to periodic inspection and testing in accordance with the requirements applicable to UN seamless steel cylinders in CSA B341‑09;

(iv)the cylinders are subjected to repairs in accordance with the requirements applicable to UN seamless steel cylinders in CSA B341-09; and

(l) the certificate holder, cylinder owner or cylinder user reports any incident involving loss of contents or failure of the cylinders to the Director, Regulatory Affairs Branch, Transportation of Dangerous Goods, Transport Canada.

This Equivalency Certificate serves as the registration of CMV srl pursuant to Annex A of CSA B341-09, for the manufacture of UN pressure receptacles of the designs specified herein. CMV srl's registered mark, pursuant to CSA B341-09, is:

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

The certificate holder has demonstrated that the manufacture of cylinders with a water capacity between 150 L and 220 L in accordance with Standard ISO 9809‑1:1999 under the conditions specified, results in a cylinder which could be used with equivalent safety to that of a UN cylinder authorized by CSA B341. This Equivalency Certificate authorizes the manufacture and use of these cylinders under the Transportation of Dangerous Goods Regulations.
