CONDITIONS

This Equivalency Certificate authorizes Plains Midstream Canada to load or unload , at the Kerrobert Unit Train Terminal (KUTT) in Kerrobert, SK, dangerous goods that are UN1267, PETROLEUM CRUDE OIL, Class 3, Packing Group I, II, or III, from railway tank cars in a manner that does not comply with clause 10.6.2 b. of Transport Canada Standard TP14877E, "Containers for Transport of Dangerous Goods by Rail", December 2013, incorporated by reference in subparagraph 5.14(1)(b)(ii) of the Transportation of Dangerous Goods Regulations, if:

(a) the tank cars are loaded or unloaded in accordance with the procedure Red Zone Protection - Securing the Unit Train for Loading and Permit Receivers [Section K.5 in PMC GOI];

(b) the coupled string with the tank cars and other railway vehicles have at least six (6) handbrakes applied as a backup to the air brakes;

CONDITIONS

(c) the coupled string with the tank cars and other railway vehicles do not use air brakes in lieu of handbrakes to secure unattended equipment [Section K.4 in PMC GOI - TC Handbrake Chart].

(d) the certificate holder ensures that the personnel loading or unloadingthe dangerous goods is trained in regards to the conditions of this Equivalency Certificate.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

The certificate holder uses a specialized procedure to immobilize the train for the loading or unloading of the railway tank cars. By following their procedure, it is believed that the certificate holder is demonstrating the same level of safety as using handbrakes and wheel chocks in accordance with the standard.
