CONDITIONS

This Equivalency Certificate authorizes the Transportation of Dangerous Goods Directorate of Transport Canada to handle, offer for transport or transport, and authorizes any person to handle, offer for transport or transport on behalf of the certificate holder, by road vehicle, dangerous goods that are oilfield products that the consignor reasonably believes to be dangerous goods, but the classification or the exact chemical composition of the goods is unknown and cannot be readily determined, in a manner that does not comply with Part 2 (Classification), Part 3 (Documentation), Part 4 (Dangerous Goods Safety Marks), Part 5 (Means of Containment), Part 6 (Training), and Part 7 (Emergency Response Assistance Plan) of the Transportation of Dangerous Goods Regulations, if:

(a) the dangerous goods are contained in a means of containment, which is selected, used and manufactured as per the requirements of Equivalency Certificate SU 9269 (Ren. 7), issued to Proserv UK Limited;

(b) despite condition (c) of Equivalency Certificate SU 9269 (Ren. 7) issued to Proserv UK Limited, the means of containment may be used to transport dangerous goods that are oilfield products that the consignor reasonably believes to be dangerous goods, but the classification or the exact chemical composition of the goods is unknown and cannot be readily determined;

CONDITIONS

(c) the dangerous goods are in transport for the purposes of classifying, analyzing or testing;

(d) the dangerous goods are believed not to contain explosives, infectious substances or radioactive materials;

(e) the dangerous goods are accompanied by a document that includes the name and address of the consignor and the words "test samples" or "échantillons d'épreuve";

(f) each means of containment has marked on it the words "test samples" or "échantillons d'épreuve" and the words are legible and displayed on a contrasting background; and

(g) a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the ICAO Technical Instructions for the Safe Transportation of Dangerous Goods by Air,the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulations not specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the transportation of oilfield product samples from oilfield wells to laboratories for the purposes of classifying, analyzing or testing. The TDG Directorate uses specially designed sampling equipment authorized under Equivalency Certificate SU 9269 (Ren. 7) to take samples and transport them for analysis. Equivalency Certificate SH 11574 (Ren. 2) authorizes the TDG Directorate to transport samples by following requirements similar to the requirements of section 1.19.1 of the TDG Regulations, except that the gross mass of the dangerous goods is not limited to 10 kg.
