CONDITIONS

This Equivalency Certificate authorizes the Department of National Defence, to handle, offer for transport or transport, and authorizes any person to handle or transport, on behalf of the Department of National Defense, by road or railway vehicle, by cargo aircraft or by ship, dangerous goods listed in Appendix A of this certificate, in a manner that does not comply with Part 3 (Documentation) and Part 5 (Means of Containment) of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the dangerous goods are in quantities necessary to respond to an emergency that endangers public safety and that are in transport in an Explosive Ordnance Disposal (EOD) container that is dedicated to emergency response;

(b) the dangerous goods are not forbidden for transport in Schedule 1 or Schedule 3 of the Transportation of Dangerous Goods Regulations or, for transport by aircraft, in the Technical Instructions for the Safe Transport of Dangerous Goods by Air;

(c) the dangerous goods safety marks required by Part 4 of the Transportation of Dangerous Goods Regulationsare displayed on each side and each end of the Explosive Ordnance Disposal (EOD) container;

CONDITIONS

(d) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(e) a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods;

(f) a paper or electronic inventory of all dangerous goods contained in the Explosive Ordnance Disposal (EOD) container accompanies the dangerous goods.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the transportation of Explosive Ordnance Disposal (EOD) containers, dedicated to emergency response. The EOD containers contain dangerous goods in quantities necessary to deal with emergency situations arising both nationally and internationally. The short notice and rapid deployment of these EOD containers to the emergency location is essential.
