CONDITIONS

This Equivalency Certificate authorizes DyTerra Corporation to sell, offer for sale, distribute, and deliver in Canada, means of containment described as volume measurement and calibration devices referred to as "provers" that do not comply with Part 5 (Means of Containment) of the Transportation of Dangerous Goods Regulations, and authorizes any person to handle, offer for transport or transport in such means of containment, by road vehicle, dangerous goods that are UN1005, ANHYDROUS AMMONIA, Class 2.3(8), if:

(a) the means of containment:

(i) is a large means of containment, as defined in the Transportation of Dangerous Goods Regulations, not exceeding 3 780 L (1 000 US gal),

(ii) is assembled by DyTerra Corporation as per the configuration filed by DyTerra Corporation December 15, 2014, with the Transportation of Dangerous Goods Directorate,

(iii) is accompanied by a copy of this Equivalency Certificate,

(iv) is a volume measurement and calibration device referred to as a "prover", mounted on a highway vehicle for transport to and from worksites

(v) is not intended for the transportation of dangerous goods and the presence of dangerous goods is due only to the use of the means of containment for the processing, storage, or use of the dangerous goods at fixed locations,

(vi) prior to moving, is emptied to the maximum extent possible, and the residual amount of the dangerous goods never exceeds 50 L,

(vii) is periodically inspected and tested in accordance with the requirements for TC 51 tanks in Clause 7 of CSA Standard B620-09, "Highway tanks and TC portable tanks for the transportation of dangerous goods", January 2009, cited in the rest of this certificate as CSA B620-09, except that the external visual inspection shall be conducted annually and the pressure test shall be conducted every 3 years,

(viii) has a MAWP greater than or equal to 1 725 kPa, gauge (250 psi) and meets the equirements of the ASME Code under which it was built and is marked accordingly,

(ix) is equipped with safety relief valves meeting the requirements of CGA S-1.2 Standard, "Pressure Relief Device Standards-Part 2-Portable Containers for Compressed Gases", March 2009, and

(x) any repairs to the means of containment are done in compliance with the requirements for TC 51 tanks in Clause 7.5 of CSA B620-09;

(b) the means of containment is loaded and secured on the means of transport in such a way as to prevent, under normal conditions of transport, damage to the means of containment or to the means of transport that could lead to an accidental release of the dangerous goods;

(c) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the person handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate; and

(d) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SH 11552 (REN 1)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the applicant to sell, offer for sale, distribute, deliver, and transport means of containment that do not comply with the requirements set out in Part 5 (Means of Containment) of the Transportation of Dangerous Goods Regulations. The ASME certified means of containment may contain residual amounts of dangerous goods due to storage, processing, servicing, or use of dangerous goods at fixed locations, as part of measurement and calibration processes. The means of containment must be emptied to the maximum extent possible, never exceeding 50 L, prior to being transported and must be periodically inspected and tested as required by CSA B620.
