CONDITIONS

This Equivalency Certificate authorizes Praxair Canada Inc., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road vehicle, dangerous goods that are UN1845, CARBON DIOXIDE, SOLID; or DRY ICE, Class 9, in a manner that does not comply with subparagraph 5.14(1)(a)(i) of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the dangerous goods are contained in a strong means of containment constructed of suitable material, and of adequate strength and design in relation to the means of containment capacity and its intended use;

(b) the means of containment containing the dangerous goods is designed and constructed to permit the release of carbon dioxide gas to prevent the build-up of pressure that could rupture the means of containment;

(c) the means of containment containing the dangerous goods is filled, closed, secured, and maintained so that under normal conditions of transport, including handling, there will be no accidental release of the dangerous goods that could endanger public safety;

(d) the means of containment has a capacity greater than 450 L and less than or equal to 3 000 L;

(e) before each use, the means of containment is visually inspected for any defects, signs of cracks, and other signs of damage;

(f) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(g) a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods;

(h) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SH 11542 (Ren. 1)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the transportation of dry ice in means of containment having a capacity greater than 450 L and less than or equal to 3 000 L in a manner that does not comply with subparagraph 5.14(1)(a)(i) of the Transportation of Dangerous Goods Regulations. As per Packing Instruction 11 of the National Standard of Canada CAN/CGSB-43.146-2002, "Design, Manufacture and Use of Intermediate Bulk Containers for the Transportation of Dangerous Goods", the dangerous goods UN1845, CARBON DIOXIDE, SOLID; or DRY ICE, Class 9, shall not be offered for transport or transported in an Intermediate Bulk Container (IBC). The strong means of containment shall be constructed of suitable material, and of adequate strength and design in relation to the means of containment capacity and its intended use, and permit the release of carbon dioxide gas to prevent the build-up of pressure that could rupture the means of containment.
