CONDITIONS

This Equivalency Certificate authorizes SMBC Rail Services LLC to handle or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by railway vehicle, tank cars that are qualified and marked in a manner that does not comply with some provisions of clause 9.5.4.1 of the Transport Canada Standard TP14877, "Containers for Transport of Dangerous Goods by Rail, a Transport Canada Standard", December 2013, if:

(a) for the purposes of this certificate the tank cars are operating in Canada, and bear tank car reporting marks and numbers owned by SMBC Rail Services LLC, and are covered within the scope of the reliability analyses presented in support of the Equivalency Certificate application, on file with the Executive Director, Regulatory Affairs Branch, Transportation of Dangerous Goods Directorate, Transport Canada, and

(i) the tank cars were constructed after 1992,

(ii) the tank cars are not used for the transportation of UN1832, SULPHURIC ACID, SPENT,

(iii) the tank cars are equipped with one of the following underframe type: GAT020, TRN021, TRN022, TRN023, TRN024, TRNTY3, UTLZBG, and UTLZBN,

(iv) the tank cars have a steel tank car tank conforming to either ASTM A516-70 or AAR TC128 Gr B, and conform to one of the following TC or DOT specifications: 111A60W1, 111A100W1 or 111A100W3,

(v) the reporting marks and numbers of the tank cars covered under this certificate are listed in the file supplied to the Director, Regulatory Affairs Branch, Transportation of Dangerous Goods Directorate, Transport Canada on October 30, 2014, or in any subsequent updated list to be sent to the Director at six months interval beginning on June 1st, 2015;

(b) the maximum qualification interval after manufacturing for the first visual inspection, the first structural integrity inspection, the first thickness test, and the first safety systems inspection, with the exception of thermal protection systems does not exceed 15 years. Subsequent qualifications intervals will be performed at an interval not exceeding 10 years;

(c) with the exception of pressure relief devices the maximum qualification interval after manufacturing for the first service equipment inspection is

15 years, and in addition:

(i) tank cars carrying dangerous goods with corrosion rates to service equipment material of 64µm (2 mils) per year to 510µm (20 mils) per year will receive one additional service equipment inspection, nominally

8 years after manufacturing,

(ii) tank cars carrying dangerous goods with corrosion rates to service equipment material of less than 64µm (2 mils) per year but that may generate corrosive by-products will receive one additional service equipment inspection, nominally 8 years after manufacturing,

(iii) tank cars carrying dangerous goods with corrosion rates to service equipment material exceeding 510µm (20 mils) per year will receive two additional service equipment inspections, nominally 5 and 10 years after manufacturing,

(iv) additional adjustments may be made based on documented quantitative analysis or qualitative knowledge of in-service performance. Subsequent qualifications after 15 years from construction will be performed at an interval not exceeding 10 years;

(d) the revised due date for the qualification items referred to in conditions (b) and (c) of this certificate is stencilled on each tank car no later than the tenth year following the manufacturing date of the tank cars;

(e) a re-evaluation of the alternate qualification options authorized under this certificate is promptly made if any detrimental defects are identified;

(f) the certificate number "SR 11536" is stenciled on each long side of each tank car covered under the provisions of this certificate in letters and numbers no less than 100 mm (4 in.) high;

This certificate applies to any person who handles, offers for transport, or transports dangerous goods in a tank car that is authorized, tested, and inspected in accordance with this certificate.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This certificate allows an extension to the maximum interval prescribed for some of the inspections and tests required as part of the qualification for tank cars used to transport dangerous goods. This allowance applies to the first qualification after manufacturing for certain specific tank cars identified in the application. Reliability analyses were performed and presented in support of the certificate.
