CONDITIONS

This Equivalency Certificate authorizes SodaStream Canada Ltd., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods that are UN1013, CARBON DIOXIDE, Class 2.2, in a manner that does not comply with paragraph 3.5(1)(d) and Part 6 (Training) of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the dangerous goods are transported from the consumer or retailer to a SodaStream Canada Ltd. facility or from a SodaStream Canada Ltd. facility to a SodaStream USA Refill facility for recycling, recall, replacement or disposal;

(b) the dangerous goods are contained in a means of containment, which complies with the requirements of Part 5 of the Transportation of Dangerous Goods Regulations;

(c) the capacity of each cylinder is less than or equal to 1.41 L;

(d) a means of valve protection is not required;

(e) damaged cylinders are not handled, offered for transport or transported under the conditions stipulated in this Equivalency Certificate;

CONDITIONS

(f) SodaStream Canada Ltd., provides the consumer or retailer with processes and procedures containing sufficient information and detailed instructions for the consumer or retailer to be able to handle and offer for transport the used cylinders;

(g) SodaStream Canada Ltd., provides the consumer or retailer with a packaging kit that includes a high quality fiberboard overpack, complete with pre-printed dangerous goods safety marks and a dangerous goods shipping document, as well as detailed instructions and support for the consumer or retailer to pack the cylinders into the fiberboard overpack;

(h) each cylinder is placed in an individual compartment inside the fiberboard overpack;

(i) the consumer or retailer complies with the closure instructions pre-printed on the overpack;

(j) the overpack is not opened during transport;

(k) the cylinders contained in the fiberboard overpack are considered as being included in Class 2.2, Non-flammable and Non-toxic Gases;

(l) SodaStream Canada Ltd., assumes all of the shipper's duties and responsibilities related to the return of the used cylinders and ensures that the dangerous goods are handled, offered for transport or transported in compliance with the conditions of this Equivalency Certificate and the applicable sections of the Transportation of Dangerous Goods Regulations;

(m) SodaStream Canada Ltd., has a documented quality assurance (QA) process in place to constantly monitor compliance with the conditions of this Equivalency Certificate and the applicable sections of the Transportation of Dangerous Goods Regulations, including the acceptance procedures of the transporter;

(n) the Equivalency Certificate number "SU 11512" is visibly and legibly marked on the external surface of the fiberboard overpack;

CONDITIONS

(o) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 11512"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the certificate holder to offer for transport and transport dangerous goods that are UN1013, CARBON DIOXIDE, Class 2.2, in a manner that does not comply with paragraph 3.5(1)(d) and Part 6 (Training) of the Transportation of Dangerous Goods Regulations, when the used cylinders are being transported from the consumer or retailer to a SodaStream Canada Ltd. facility or from a SodaStream Canada Ltd. facility to a SodaStream USA Refill facility for recycling, recall, replacement or disposal.

Through a quality assurance process and procedures containing sufficient information and detailed instructions for the consumer or retailer to be able to handle and offer for transport the used cylinders, the certificate holder assumes all of the shipper's duties and responsibilities related to the return of the used cylinders, and ensures that the dangerous goods are handled, offered for transport, and transported in compliance with the conditions of this Equivalency Certificate and the applicable sections of the Transportation of Dangerous Goods Regulations.
