CONDITIONS

This Equivalency Certificate authorizes Bearskin Lake Air Service LP to handle, offer for transport or transport by aircraft within Canada dangerous goods that are aerosols included in Class 2.1 or 2.2, are UN3175, SOLIDS CONTAINING FLAMMABLE LIQUID, N.O.S., or are included in Class 3 and Packing Group II or III or in Class 6.1 and Packing Group III, in a manner that does not comply with paragraph 12.8(1)(a) of the Transportation of Dangerous Goods Regulations, if:

(a) the person handling, offering for transport or transporting the dangerous goods must comply with subparagraph 12.8(1)(a)(i), except paragraphs 12.1(1)(c), (d), and (e) of the Transportation of Dangerous Goods Regulations;

(b) the person handling, offering for transport or transporting the dangerous goods must comply with subparagraph 12.8(1)(a)(ii) of the Transportation of Dangerous Goods Regulations, except Chapter 1 (Acceptance Procedures) and Section 4.1 (Information to the Pilot-in-Command) of Chapter 4 (Provision of Information) of Part 7 (Operator's Responsibilities) of the Technical Instructions for the Safe Transportation of Dangerous Goods by Air;

(c) the operator must not accept for transport aboard an aircraft a means of containment, overpack, unit load device or other type of pallet containing the above-mentioned dangerous goods, unless the operator has verified the following:

(i) each means of containment, overpack, unit load device or other type of pallet is not leaking and there is no indication that its integrity has been compromised;

(ii) each means of containment has a gross mass that is less than or equal to 30 kg;

(iii) each means of containment presented under this Equivalency Certificate bears all marks required under section 12.8 of the Transportation of Dangerous Goods Regulations;

(d) when the person loading or supervising the loading of the dangerous goods on board the aircraft is not a crew member, the pilot-in-command must be notified, in writing, that the dangerous goods are transported as "Air Transport, 12.8, Consumer Commodity", the number of means of containment and their exact loading location;

(e) emergency response procedures pertinent to ID 8000, Consumer Commodities (dangerous goods that are aerosols included in Class 2.1 or 2.2, UN3175, SOLIDS CONTAINING FLAMMABLE LIQUID, N.O.S., or dangerous goods included in Class 3 and Packing Group II or III or in Class 6.1 and Packing Group III) must be available to flight crew at all times while these dangerous goods are on the aircraft; and

(f) a paper or electronic copy of this Equivalency Certificate is carried on board the aircraft and provided to the pilot-in-command.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate allows the air operator to comply with the requirements of section 12.8 (Packing Instruction Y963). Dangerous goods that are aerosols included in Class 2.1 or 2.2, UN3175, SOLIDS CONTAINING FLAMMABLE LIQUID, N.O.S., or dangerous goods included in Class 3 and Packing Group II or III or in Class 6.1 and Packing Group III are handled, offered for transport or transported at a level of safety equivalent to Packing Instruction Y963 of the Technical Instructions for the Safe Transportation of Dangerous Goods by Air.
