CONDITIONS

This Equivalency Certificate authorizes Teeko Testing & Services Ltd., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road vehicle, dangerous goods consisting of mixed oilfield production fluids, which is impractical to classify in the field, in a manner that does not comply with Part 2 (Classification) and Part 5 (Means of Containment) of the Transportation of Dangerous Goods Regulations, if:

(a) the dangerous goods are classified as UN2924, FLAMMABLE LIQUID, CORROSIVE, N.O.S. (mixed oilfield production fluid), Class 3(8),

Packing Group II;

(b) the means of containment:

(i) is not intended for the transportation of dangerous goods, and the presence of dangerous goods is due only to the use of the means of containment for the processing, storage or use of the dangerous goods at fixed locations,

(ii) prior to moving, is emptied to the maximum extent possible, and the residual amount of the dangerous goods never exceed 50 Lwhen in transport,

CONDITIONS

(iii) is designed, constructed, closed, secured, and maintained so that under normal conditions of transport, including handling, there will be no accidental release of dangerous goods that could endanger public safety;

(c) the means of containment is loaded and secured on the means of transport in such a way as to prevent, under normal conditions of transport, damage to the means of containment or to the means of transport that could lead to an accidental release of the dangerous goods;

(d) the means of containment:

(i) has displayed on it the appropriate dangerous goods safety marks for UN2924 as per Part 4 of the Transportation of Dangerous Goods Regulations;

(ii) is visibly and legibly marked with the Equivalency Certificate number "SH 11464" in characters not less than 5 cm (2 in.) in height;

(e) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(f) the shipping document that accompanies the dangerous goods includes the information required as per section 3.5 of the Transportation of Dangerous Goods Regulations except for clause 3.5(1)(c)(i)(A);

CONDITIONS

(g) a copy of the Equivalency Certificate accompanies the dangerous goods and the driver is aware of the location of the Equivalency Certificate.

For the purpose of sections 8.1 and 8.3 of the Transportation of Dangerous Goods Regulations, the dangerous goods shall be deemed to be FLAMMABLE LIQUIDS, CORROSIVE, N.O.S.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate allows relief from Part 2 and Part 5 of the Transportation of Dangerous Goods Regulations for the handling, offering for transport or transporting of residue quantities of mixed oilfield production fluids. Due to the nature of oilfield production fluids and the variance in composition, the dangerous goods are classified as UN2924, FLAMMABLE LIQUID, CORROSIVE, N.O.S., Class 3(8), Packing Group II, which represent the "worst case scenario".
