CONDITIONS

This Equivalency Certificate authorizes Transport Desgagnés Inc., to handle, offer for transport or transport by passenger ship, dangerous goods that are UN1090, ACETONE, Class 3, Packing Group II, UN1203, GASOLINE, Class 3, Packing Group II, and UN1748, CALCIUM HYPOCHLORITE MIXTURE, DRY, Class 5.1, Packing Group II, in a manner that does not comply with subsection 1.6(1) and column 8 of Schedule 1 of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the dangerous goods are transported in small means of containment compliant with Part 5 of the Transportation of Dangerous Goods Regulations;

(b) the dangerous goods are transported on board the vessel Bella Desgagnés;

(c) the means of containment containing the dangerous goods are designed, constructed, filled, closed, secured in an open top 6-metre (20-foot) sea container and maintained so that under normal conditions of transport, including handling, there will be no release of the dangerous goods that could endanger public safety;

CONDITIONS

(d) UN1090, ACETONE, Class 3, Packing Group II, is contained in means of containment having a capacity less than or equal to 4 L and a maximum
of 5 means of containment are transported on board the ship;

(e) UN1203, GASOLINE, Class 3, Packing Group II, is contained in drums having a capacity less than or equal to 205 L;

(f) UN1748, CALCIUM HYPOCHLORITE MIXTURE, DRY, Class 5.1, Packing Group II, is contained in means of containment having a gross mass less than or equal to 30 kg and the total gross mass of all the means of containment on board the ship, is less than or equal to 100 kg;

(g) a maximum of 2 open top 6-metre (20-foot) sea containers containing dangerous goods are transported on board the vessel Bella Desgagnés at all times;

(h) the open top 6-metre (20-foot) sea containers containing the dangerous goods are stowed as far aft as possible;

(i) the open top 6-metre (20-foot) sea containers containing the dangerous goods are fitted with a jettisoning equipment system (Ref Dwgs # RNI‑JETTISON-01, # C15-03-160-02, # C14‑11‑590‑01 R.1(3) and # C15‑03‑601‑01 on file with the Director, Regulatory Affairs, Transport Dangerous Goods, Transport Canada) at all times during transport with no other sea containers or means of containment stowed over them;

(j) the jettisoning equipment system referred to in condition (i) of this certificate shall be installed, certified, and proven in operation before October 15th, 2015. In the meantime, the ship's crane shall be maintained ready for jettisoning the sea containers containing the dangerous goods, which shall be slung during transit;

(k) passengers are not permitted on the aft cargo deck where dangerous goods are stowed;

(l) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(m) a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods on board the vessel Bella Desgagnés;

CONDITIONS

(n) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SM 11426 (Ren. 3)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the certificate holder to handle, offer for transport or transport, by passenger ship, dangerous goods in quantities greater than what is prescribed in the Transportation of Dangerous Goods Regulations. This Equivalency Certificate also authorizes the transportation of dangerous goods which are forbidden for transport by passenger vessels. The Bella Desgagnés services many remote communities along Quebec's north shore. The dangerous goods are stowed as far aft as possible. The Bella Desgagnés is equipped with jettisoning equipment for the dangerous goods containers as well as additional firefighting equipment.

The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Cargo, Fumigation and Tackle Regulations not specifically addressed in this certificate.
