CONDITIONS

This Equivalency Certificate (National Competent Authority Approval) authorizes General Dynamics Ordnance and Tactical Systems-Canada Inc., and any person, to use a means of containment which does not comply with subsection 5.1(3) of the Transportation of Dangerous Goods Regulations, for dangerous goods that are UN0168, PROJECTILES with bursting charge, Class 1.1D, Packing Group II, if:

(a) the dangerous goods have been classified as UN0168, PROJECTILE 155 MM, HE, M107, Class 1.1D, Packing Group II, by the Chief Inspector of Explosives, Explosives Regulatory Division, Natural Resources Canada as shown in Certificates of Authorization number C-95062101;

(b) the dangerous goods are without any means of initiation and instead have inert steel plugs threaded into their fuze cavities;

(c) the dangerous goods are packaged on pallets, where each pallet consists of 8 articles, a wooden base and a wooden top held together with 3 steel straps, in accordance with the design information filed with the Executive Director, Regulatory Frameworks and International Engagement, Regulatory Affairs Branch, Transportation of Dangerous Goods Directorate, Transport Canada; and

(d) the shipping document that accompanies the dangerous goods packaged as authorized in this Equivalency Certificate includes the following information legibly and indelibly printed:

"Packaging approved by the Competent Authority of Canada"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This competent authority approval authorizes the transport of these explosive articles without being contained in packaging. These articles are large, robust, intended for military use, and without their means of initiation. The method of handling these articles satisfies the performance requirement of Note 1 of Packing Instruction EP30 of CGSB 43.151.
