CONDITIONS

1. This Equivalency Certificate authorizes Welland Hydro-Electric System Corporation to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods that are UN2315, POLYCHLORINATED BIPHENYLS, LIQUID, regulated only when the concentration is more than 50 ppm, by mass, Class 9, Packing Group II, or UN3432, POLYCHLORINATED BIPHENYLS, SOLID, regulated only when the concentration is more than 50 ppm, by mass, Class 9, Packing Group II, in a manner that does not comply with Part 3 (Documentation), Part 4 (Dangerous Goods Safety Marks), and Part 5 (Means of Containment) of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the dangerous goods are contained in electrical equipment that:

(i) is designed to perform a function other than solely to contain the PCB mixture,

(ii) is in a leak free condition or is contained to prevent release into the environment,

(iii)contains not more than 2 000 L of liquid PCB mixture,

CONDITIONS

(iv)is inspected during transport at intervals not exceeding two hours or
200 km whichever is more frequent,

(v) is transported in its normal operating position or in a secure manner,

(vi)in the case of equipment that has been drained, the equipment contains the remaining PCB mixture in the base cavity below the drain opening,

(vii) is secured on the means of transport in such a way as to prevent, under normal conditions of transport, damage to the means of containment or to the means of transport that could lead to an accidental release of the dangerous goods;

(b) when the dangerous goods are transported by ship on a domestic voyage, the person accompanying the dangerous goods notifies the master of the ship or the marine carrier of the presence of the dangerous goods and provides to the master, a document that includes the words "marine pollutant" as well as the total quantity of dangerous goods transported;

(c) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(d) a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods.

CONDITIONS

2. This Equivalency Certificate also authorizes Welland Hydro-Electric System Corporation to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods that are UN2315, POLYCHLORINATED BIPHENYLS, LIQUID, regulated only when the concentration is more than 50 ppm, by mass, Class 9, Packing Group II, or UN3432, POLYCHLORINATED BIPHENYLS, SOLID, regulated only when the concentration is more than 50 ppm, by mass, Class 9, Packing Group II, in a manner that does not comply with Part 3 (Documentation), Part 4 (Dangerous Goods Safety Marks), and Part 5 (Means of Containment) ofthe Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the dangerous goods are contained in electrical equipment that:

(i) is used for emergencies as a replacement for stationary equipment,

(ii) is designed to perform a function other than solely to contain PCB,

(iii)is in a leak free condition or is contained to prevent release into the environment,

(iv)is permanently mounted on a road vehicle,

(v) is secured on the means of transport in such a way as to prevent, under normal conditions of transport, damage to the means of containment or to the means of transport that could lead to an accidental release of the dangerous goods; and

(b) when the dangerous goods are transported by ship on a domestic voyage, the person accompanying the dangerous goods notifies the master of the ship or the marine carrier of the presence of the dangerous goods and provides to the master, a document that includes the words "marine pollutant" as well as the total quantity of dangerous goods transported;

(c) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(d) a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods.

CONDITIONS

3. Until June 30, 2016, this Equivalency Certificate authorizes Welland Hydro-Electric System Corporation to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods that are UN2315, POLYCHLORINATED BIPHENYLS, LIQUID, regulated only when the concentration is more than 50 ppm, by mass, Class 9, Packing Group II, or UN3432, POLYCHLORINATED BIPHENYLS, SOLID, regulated only when the concentration is more than 50 ppm, by mass, Class 9, Packing Group II, in a manner that does not comply with Part 6 (Training) of the Transportation of Dangerous Goods Regulations. This offers a transition period to allow Welland Hydro-Electric System Corporation and its personnel, who handle, offer for transport or transport dangerous goods to be fully trained and hold a training certificate as per the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations. Section 3 of this Equivalency Certificate will not be valid after June 30, 2016, and will not be renewed.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate allows the certificate holder to ship PCB's in electrical equipment that is not in compliance with the packaging standards.

The certificate holder is also exempted from the requirements of dangerous goods safety marks and documentation. Compliance with the Transportation of Dangerous Goods Regulations would require the certificate holder to drain the oil from the electrical equipment under field conditions that would increase the risk of a spill. The certificate holder has been transporting this type of equipment for many years in a manner that reflects the conditions outlined in this certificate.

This Equivalency Certificate offers a transition period until June 30, 2016, to allow Welland Hydro-Electric System Corporation and its personnel, who handle, offer for transport or transport dangerous goods to be trained and hold a training certificate as per the requirements of Part 6 - Training of the Transportation of Dangerous Goods Regulations. Section 3 of this Equivalency Certificate is not valid after June 30, 2016, and will not be renewed.
