CONDITIONS

This Equivalency Certificate authorizes Welker, Inc., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicle, by ship on a domestic voyage, or by cargo aircraft, dangerous goods that are UN1202, DIESEL FUEL,

Class 3, Packing Group III, UN1203, GASOLINE, Class 3, Packing Group II, UN1267, PETROLEUM CRUDE OIL, Class 3, Packing Group I, II, or III, UN1268, PETROLEUM PRODUCTS, N.O.S., Class 3, Packing Group I, II, or III,UN3295, HYDROCARBONS, LIQUID, N.O.S., Class 3, Packing Group I, II or III, or UN3494, PETROLEUM SOUR CRUDE OIL, FLAMMABLE, TOXIC,

Class 3 (6.1), Packing Group I, II or III in a manner that does not comply with sections 5.1 and 5.12 of the Transportation of Dangerous Goods Regulations, or with Column 12 of Part 3 of Technical Instructions for the Safe Transport of Dangerous Goods by Air, if:

(a) the means of containment complies with the ASME Code, Section VIII Division 1 and is marked with an ASME U or Um stamp;

(b) the means of containment has a marked Maximum Allowable Working Pressure equal to or greater than 900 kPa (130 psi);

CONDITIONS

(c) the means of containment is manufactured under a registered Quality Management System that essentially meets the requirements of standard ISO 9001-2008 or ISO 9001-2015 "Quality management systems - Requirements";

(d) the means of containment has a maximum capacity of 9.4 L (2.5 US gallons);

(e) the means of containment is maintained so that it retains its initial pressure retention capability;

(f) the means of containment is visibly and legibly marked with the Equivalency Certificate number "SU 11319";

(g) if transported by cargo aircraft, the means of containment is placed in a strong outer packaging and the strong outer packaging is visibly and legibly marked with the Equivalency Certificate number "SU 11319";

(h) the means of containment is designed, constructed, filled, closed, secured, and maintained so that under normal conditions of transport, including handling, there will be no accidental release of the dangerous goods that could endanger public safety;

(i) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(j) a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods;

(k) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 11319 (Ren. 1)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

The minimum prescribed container for these liquid dangerous goods would be a UN Standardized drum or jerrican made of metal or plastic, which would be pressure-rated for 250 kPa. The proposed containers are pressure vessels manufactured of stainless steel under a Registered Quality Management System and are pressure-rated for at least 900 kPa. The level of safety is maintained or increased over the permitted containers.
