CONDITIONS

This Equivalency Certificate authorizes Fednav Limited, to handle, offer for transport and transport by ship on a domestic voyage, dangerous goods that are UN3342, XANTHATES, Class 4.2, Packing Group II or III, in a manner that does not comply with column 16 of chapter 3.2 (Dangerous Goods List) of part 3 and section 7.1.1.2 of chapter 7.1 of part 7 of the International Maritime Dangerous Goods Code (IMDG Code), as incorporated by reference in section 11.1 of the Transportation of Dangerous Goods Regulations, if:

(a) the dangerous goods are transported on the vessel MV Arctic;

(b) the dangerous goods are contained in means of containment which comply with the requirements of Part 5 of the Transportation of Dangerous Goods Regulations;

(c) the dangerous goods containers are transported below deck in cargo holds no. 2, no. 3, no. 5, and no. 6;

(d) each hold can be flooded with water if necessary;

(e) each hold is kept in an inert state with temperature sensing devices inside, the inert gas having no reaction with the cargo;

CONDITIONS

(f) a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

The IMDG Code requires that the cargo is stowed on deck. However, the vessel MV Arctic does not have sufficient place on deck for the number of containers of xanthates proposed to be loaded. The voyage is of a special nature as the vessel is going into arctic waters and not many ships are available for this voyage. This Equivalency Certificate authorizes the certificate holder to handle, offer for transport and transport xanthates under deck, in cargo holds. The holds are kept under inert state with temperature sensing devices inside and can be flooded with water if necessary.
