CONDITIONS

This Equivalency Certificate authorizes the Canadian National Railway (CN) to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by railway vehicle, dangerous goods that are UN1972, NATURAL GAS, REFRIGERATED LIQUID, Class 2.1, in a manner that does not comply with paragraph 3.5(d), part 5, and section 10.6 of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the means of transport is a railway vehicle designated as a tender, consists of one permanently attached means of containment for the dangerous goods, and conforms to the design information on file with the Executive Director, Regulatory Frameworks and International Engagement, Regulatory Affairs Branch, Transportation of Dangerous Goods Directorate, Transport Canada;

(b) the means of containment is a vacuum-insulated T75 UN portable tank that meets the requirements of CSA B625-08, "Portable tanks for the transport of dangerous goods", cited in the rest of this certificate as CSA B625‑08;

CONDITIONS

(c) the use of the means of containment is in accordance with the requirements of CSA B625-08 except that, only as required for the purpose of propulsion of the locomotive coupled to the means of transport, any valve or other opening may remain open, loading and unloading lines may remain connected and dangerous goods may be drawn off;

(d) the tender is not used for delivery of the dangerous goods to a destination;

(e) the certificate holder provides the Executive Director, Regulatory Frameworks and International Engagement, Regulatory Affairs Branch, Transportation of Dangerous Goods Directorate, Transport Canada, with an analysis of any performance data on unintended lading loss;

(f) the certificate number "SR 11311" is marked on each long side of the means of containment in characters not less than 50 mm high and each long side of the means of transport in characters not less than 100 mm high; and

(g) the Canadian Transport Emergency Centre (CANUTEC) is promptly advised of any accident, incident, leakage or any unusual situations that may arise by dialing 613-996-6666 or *666 on a cellular phone.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the use of an LNG tender car that is fitted with a UN portable tank designed to provide fuel to locomotives. The tank is selected and used in accordance with CSA B625-08.

This activity is being done on a trial basis.
