CONDITIONS

This Equivalency Certificate authorizes Aeryon Labs Inc., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicle, by cargo aircraft, or by ship on a domestic voyage, dangerous goods that are UN3480, LITHIUM ION BATTERIES (including lithium ion polymer batteries), Class 9, or UN3481, LITHIUM ION BATTERIES PACKED WITH EQUIPMENT (including lithium ion polymer batteries), Class 9, in accordance with special provision A88 of the Technical Instructions for the Safe Transport of Dangerous Goods by Air and in a manner that does not comply with section 2.43.1 of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) each cell has been determined to meet the criteria for assignment to Class 9 on the basis of tests carried out in accordance with the Recommendations on the Transport of Dangerous Goods - Manual of Tests and Criteria, Part III, subsection 38.3;

(b) each battery or battery assembly has not been tested in accordance with the Recommendations on the Transport of Dangerous Goods - Manual of Tests and Criteria, Part III, subsection 38.3, and therefore, do not meet the inclusion criteria for Class 9;

CONDITIONS

(c) the dangerous goods are:

(i) annual production runs consisting of not more than 100 lithium batteries or cells, or

(ii) pre-production prototypes of lithium cells or batteries;

(d) the cells or batteries are in transport for the purpose of testing;

(e) each cell or battery incorporates a safety venting device or is designed to preclude a violent rupture under normal conditions of transport;

(f) each cell or battery is equipped with an effective means of preventing external short circuits;

(g) each battery containing cells or series of cells connected in parallel is equipped with effective means as necessary to prevent dangerous reverse current flow (e.g., diodes, fuses, etc.);

(h) the cells or batteries are surrounded by cushioning material that is non-combustible and non-conductive and are transported in a UN Standardized plastic box that meets the criteria for packing group I performance level, registered with Transport Canada under the registration number 2-3058;

(i) each plastic box contains no more than three (3) battery assemblies and each battery assembly has a capacity that is equal to or less than 200 Wh (Watt-hour);

(j) the batteries with a mass of 12 kg or greater and having a strong, impact resistant outer casing, or assemblies of such batteries, may be transported in strong outer packagings or protective enclosures (e.g., in fully enclosed or wooden slatted crates) or on pallets;

(k) the battery or battery assembly may have a gross mass exceeding 35 kg;

(l) a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods;

CONDITIONS

(m) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 11201 (Ren. 4)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the transportation of prototype or production run batteries that have not been fully tested. The batteries are classified as UN3480, LITHIUM ION BATTERIES (including lithium ion polymer batteries), Class 9, or UN3481, LITHIUM ION BATTERIES PACKED WITH EQUIPMENT (including lithium ion polymer batteries), Class 9.

The conditions of this certificate reflect the requirements outlined in special provision 123 of the Transportation of Dangerous Goods Regulations, in special provision A88 of the Technical Instructions for the Safe Transport of Dangerous Goods by Airas well as in the packing instruction 903 of the International Maritime Dangerous Goods Code.

This Equivalency Certificate is issued by the competent authority of Canada in accordance with special provision A88 of the Technical Instructions for the Safe Transport of Dangerous Goods by Air.
