Equivalency Certificate

CONDITIONS

1. This Equivalency Certificate authorizes Miller Environmental Corporation and its clients, to handle, offer for transport or transport, and authorizes any person to handle or transport, on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods, in a manner that does not comply with sections 2.3, 4.10, 4.11, 4.12, subsection 5.1(1), section 5.14, and Special Provision 16 of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the dangerous goods are intended for disposal, recycling or any other reclamation process, and are collected by a collection facility serving the general public;

(b) the dangerous goods are handled, offered for transport or transported in compliance with clause 14.1 of Transport Canada Standard TP14850E "Small Containers for Transport of Dangerous Goods, Classes 3, 4, 5, 6.1, 8, and 9, a Transport Canada Standard", 2nd Edition, October 2010;

(c) the most appropriate generic shipping name may be used to designate the dangerous goods contained in the outer container;

(d) each outer means of containment with a capacity less than or equal to 450 L is marked with the appropriate dangerous goods safety marks in accordance with sections 4.10, 4.11, and 4.12 of Part 4 of the Transportation of Dangerous Goods

Regulations. The dangerous goods safety marks must correspond to the generic shipping name selected as per condition (c) of this certificate;

(e) despite sections 4.15, 4.15.2, and 4.15.3 of Part 4 of the Transportation of Dangerous Goods Regulations, each outer means of containment, with a capacity over 450 L, is marked, on 2 opposite sides, with:

(i) a placard and UN number as illustrated in the Appendix to Part 4 of the Transportation of Dangerous Goods Regulations. The dangerous goods safety marks must correspond to the generic shipping name selected as per condition (c) of this certificate, or

(ii) a label for each primary and subsidiary class as well as a UN number and a shipping name in accordance with sections 4.10, 4.11, and 4.12 of Part 4 of the Transportation of Dangerous Goods Regulations. The dangerous goods safety marks must correspond to the generic shipping name selected as per condition (c) of this certificate;

(f) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(g) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 11161 (Ren. 4)"

2. This Equivalency Certificate also authorizes Miller Environmental Corporation and its clients, to handle, offer for transport or transport, and authorizes any person to handle or transport, on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods of Classes 3, 4.1, 4.2, 4.3, 5.1, 5.2, 6.1, 8, and 9, in a manner that does not comply with section 2.3 and Special Provision 16 of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the dangerous goods are intended for disposal, recycling or any other reclamation process. The dangerous goods are residential, commercial, industrial, and laboratory dangerous goods that are in small containers that may not be in standard or dangerous goods that may not be in their original container;

(b) the dangerous goods are handled, offered for transport or transported in compliance with clause 14.2 of Transport Canada Standard TP14850E "Small Containers for Transport of Dangerous Goods, Classes 3, 4, 5, 6.1, 8, and 9, a Transport Canada Standard", 2nd Edition, October 2010;

(c) in addition to the means of containment prescribed in clause 14.2 of Transport Canada Standard TP14850E "Small Containers for Transport of Dangerous Goods, Classes 3, 4, 5, 6.1, 8, and 9, a Transport Canada Standard", 2nd Edition, October 2010, the following means of containment may also be used:

(i) UN 1B2 - Aluminum drum, removable head, rated to the packing group I or II performance level,

(ii) UN 1N2 - Metal drum, removable head, rated to the packing group I or II performance level,

(iii) UN 1D - Plywood drum, rated to the packing group I or II performance level, with a polyethylene liner having a thickness of at least 76 µm (3 mils),

(iv) UN 1G - Fibre drum, rated to the packing group I or II performance level, with a polyethylene liner having a thickness of at least 76 µm (3 mils),

(v) UN 4G - Fiberboard Box, rated to the packing group I performance level, with a polyethylene liner having a thickness of at least 76 µm (3 mils);

(d) the most appropriate generic shipping name may be used to designate the dangerous goods contained in the outer container;

(e) each outer means of containment is marked with the appropriate dangerous goods safety marks in accordance with sections 4.10, 4.11, and 4.12 of Part 4 of the Transportation of Dangerous Goods Regulations. The dangerous goods safety marks must correspond to the generic shipping name selected as per condition (c) of this certificate;

(f) for dangerous goods from a laboratory or industrial facility, a complete packing list providing detailed information for each dangerous goods contained in the outer means of containment, including proper shipping name, UN number and quantity, is attached to each outer means of containment;

(g) the packing list referred to in condition 2.(f) of this certificate is also attached to the shipping document;

(h) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(i) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 11161 (Ren. 4)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This certificate authorizes the certificate holder to transport dangerous goods, which are intended for disposal, recycling or any other reclamation process. These dangerous goods may be in their original means of containment, as purchased by the retail consumer or may be in small containers that may not be in standard, or dangerous goods that may not be in their original containers. Moreover, this certificate authorizes the use of the most appropriate generic shipping name to designate the dangerous goods contained in the outer means of containment.
