This Equivalency Certificate authorizes K-G Spray Pak Inc., to sell, offer for sale, distribute or deliver in Canada, and authorizes any person to handle, offer for transport, transport or import into Canada, by road or railway vehicle, by aircraft or by ship, dangerous goods that are 1,1,1,2-TETRAFLUOROETHANE, Class 2.2, UN3159, or AEROSOLS, non‑flammable, Class 2.2, UN1950, in a manner that does not comply with subsection 5.11(1) of the Transportation of Dangerous Goods Regulations, if:

Selection and Use

(a) each aerosol container is equipped with a pressure-relief device;

(b) the contents of the aerosol container are at an internal gauge pressure no greater than 1380 kPa at 55°C;

(c) where the aerosol container is filled with a liquefied gas, the maximum filling density at 15°C is 87%;

(d) the aerosol container is not refilled;

(e) subject to conditions (f) to (n) of this certificate, each aerosol container is in compliance with specification TC-2Q in National Standard of Canada

CAN/CGSB-43.123-M86, Containers, Metal, Aerosol (TC-2P, TC-2Q), published April 1986, cited in the rest of this certificate as CAN/CGSB-43.123-M86;

(f) each aerosol container is in compliance with ITW Sexton drawing number 998D0080, titled "211 x 406 AEROSOL WITH HV400 BOTTOM (A80)", ITW Sexton drawing number 998D0081, titled "211 x 604 AEROSOL WITH HV400 BOTTOM. (A81)", or ITW Sexton drawing number 998D0057, titled "300 x 315 AEROSOL WITH HV400 BOTTOM (A57)", filed by K-G Spray-Pak Inc., on January 4, 2013 and January 7, 2013, with the Director, Regulatory Affairs Branch, Transport Dangerous Goods Directorate, Transport Canada;

(g) the maximum rated capacity of each aerosol container is no greater

than 535 mL;

(h) paragraph 3.3 of National Standard of Canada CAN/CGSB-43.123-M86 regarding closures does not apply, and the pressure-relief device is a localized area of the bottom of the aerosol container designed to fail at a gauge pressure of 2758 kPa;

(i) the cylindrical portion of the aerosol container body is seamless;

(j) despite paragraph 4.1 of CAN/CGSB-43.123-M86 regarding sampling, the interior pressure test described in paragraphs 3.5 and 4.2.1 of that standard is performed on one completed aerosol container assembly, without the pressure-relief device, from each lot of 5000 or less successively produced aerosol containers per shift. The rate of pressurization does not exceed 1.7 MPa per minute. When failure occurs below an interior gauge pressure of 3310 kPa, the lot is rejected. The result of each test is documented;

(k) the operation of the pressure-relief device is verified on at least one aerosol container in each lot of 5000 or less successively produced aerosol containers per shift. Each tested aerosol container is subjected to internal pressure increasing at not more than 1.7 MPa per minute. If the pressure-relief device does not function at between 2620 kPa and 2960 kPa, the lot is either rejected or a further five aerosol containers are selected at random from the lot and are tested. If any of the five aerosol containers fail, the entire lot is rejected. The result of each test is documented;

(l) the certificate holder retains the test records required by conditions (j) and (k) of this certificate for at least twelve months from the date of manufacture;

(m) the certificate holder provides, once per calendar year, a summary of the aerosol container manufacturing and performance experience to the Director, Regulatory Affairs Branch, Transport Dangerous Goods Directorate, Transport Canada; and

(n) the Transport Canada mark and specification designation marked on each aerosol container is:

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the ICAO Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulations not specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the use of TC-2Q type aerosol containers for the transportation of Class 2.2 dangerous goods at internal gauge pressures greater than those specified in the Transportation of Dangerous Goods Regulations. An equivalent level of safety is provided by equipping each container with a pressure-relief device and other conditions as stipulated in this certificate.

In accordance with section 9.1 of the Transportation of Dangerous Goods Regulations, the dangerous goods can be classified in accordance with US DOT 49 CFR when transported from a place in the United States to a place in Canada. When dangerous goods are reshipped within Canada, the classification of the dangerous goods must be done in accordance with Part 2 of the Transportation of Dangerous Goods Regulations. Any chemical under pressure in an aerosol container shall be transported under UN1950.
