CONDITIONS

This Equivalency Certificate authorizes Les Industries Desjardins Ltée, to design, manufacture, mark, and authorizes any person to handle, offer for transport and transport by road or railway vehicle, or by ship on a domestic voyage, means of containment in a manner that does not comply with subparagraph 5.6(a)(ii) of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the means of containment are UN standardized welded steel mobile Intermediate Bulk Containers (IBC) designed, manufactured, and marked in compliance with sections 2 to 11 of National Standard of Canada CAN/CGSB‑43.146-2002, "Design, Manufacture and Use of Intermediate Bulk Containers for the Transportation of Dangerous Goods", January 2002, with the exception of paragraph 8.1 b. - Modifications Without Retesting;

(b) the UN standardized welded steel mobile Intermediate Bulk Containers are manufactured at Les Industries Desjardins Ltée, under an ISO 9001 - Quality Management System Certification;

CONDITIONS

(c) the UN standardized welded steel mobile Intermediate Bulk Containers are manufactured in compliance with Transport Canada Certificate of Registration Numbers 4-564, 4-565, 4-577, 4‑582, 4-598, 4-619, 4-631, 4-638, and 4-652, without any construction changes (material, sheet thickness, welding, etc.);

(d) the letter "W" is added to the specification of the Intermediate Bulk Container (e.g. 31A will become 31AW);

(e) no later than December 31st annually, the certificate holder provides the Director, Regulatory Affairs Branch, Transportation of Dangerous Goods Directorate, Transport Canada, a list of all Intermediate Bulk Containers manufactured in compliance with the Certificate of Registration Numbers listed in condition (c) of this Equivalency Certificate. That list must include the dimensions, the capacity, the tare and the permissible maximum gross mass of each Intermediate Bulk Container.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the manufacture and marking of UN standardized welded steel mobile Intermediate Bulk Containers in a manner that does not comply with the requirements of paragraph 8.1 b. of the National Standard of Canada CAN/CGSB-43.146-2002, "Design, Manufacture and Use of Intermediate Bulk Containers for the Transportation of Dangerous Goods", January 2002. The overall dimension of the Intermediate Bulk Containers will not be reduced in the same proportion. The certificate holder is authorized to reduce only the length or the width or both the length and the width of the Intermediate Bulk Containers, as long as the base of the Intermediate Bulk Containers remain rectangular in shape.
