CONDITIONS

This Equivalency Certificate authorizes the members of the Canadian Propane Association to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the members of the Canadian Propane Association, by road vehicle or by ship on a domestic voyage, dangerous goods that are UN1075, Liquefied Petroleum Gases, Class 2.1 and UN1978, Propane, Class 2.1, in means of containment that do not comply with sections 4.15, 4.15.2, 4.15.3, subsection 5.1(1), subparagraphs 5.10(1)(a)(ii) and 5.10(1)(d)(iii), and subsection 5.10(2) of the Transportation of Dangerous Goods Regulations, if:

(a) subject to conditions (b) and (c) of this certificate, the requirements of CSA B340‑08, "Selection and use of cylinders, spheres, tubes, and other containers for the transportation of dangerous goods, Class 2", March 2008, cited in the rest of this certificate as CSA B340-08, are complied with;

(b) the means of containment complies with Clause 6.6 of CSA B340-08 or the TC-4BWM cylinder specification except that the water capacity of each means of containment shall not be greater than 454 L;

(c) each means of containment was manufactured prior to August 1, 2005;

CONDITIONS

(d) the means of containment have displayed on them a label and the other safety marks required in sections 4.10, 4.11, and 4.12 of the Transportation of Dangerous Goods Regulations;

(e) despite sections 4.15.4 and 4.16.1 of the Transportation of Dangerous Goods Regulations, the road vehicle transporting the dangerous goods has displayed, on each side and each end of the road vehicle, a placard that corresponds to the Class 2.1 placard set out in Part 4 of the Transportation of Dangerous Goods Regulations. The UN number corresponding to the dangerous goods transported must also be displayed on each side and each end of the road vehicle;

(f) the Canadian Propane Association ensures that a copy of this Equivalency Certificate is provided to all members of the Canadian Propane Association;

(g) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the members of the Canadian Propane Association ensure that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(h) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 11123 (Ren. 7)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

The Transportation of Dangerous Goods Regulations (TDGR) has redefined the term "small means of containment" from "a container with a water capacity of 454 L or less to a means of containment with a capacity of 450 L or less". This equivalency certificate authorizes the members of the Canadian Propane Association to transport liquefied petroleum gas and propane in means of containment up to 454 L in water capacity, in a manner that is normally only permitted for small means of containment provided that the means of containment was manufactured before August 1, 2005. The standard CSA B339-96 authorized the manufacture of cylinders having a volume of 454 L or less. This standard was replaced by standard CSA B339-02 on July 13, 2005. As per standard CSA B339-02, the maximum volume of a cylinder of specification TC‑4BWM is 450 L. Part 5 of TDGR do not authorize the manufacture of cylinders of specification TC-4BWM of more than 450 L after July 13, 2005. The Transportation of Dangerous Goods Act, 1992, requires the use of means of containment compliant with Part 5 of TDGR for the transportation of dangerous goods.

The certificate also allows safety marks required on small means of containment to be displayed on means of containment that are 454 L or less instead of placards.
