CONDITIONS

This Equivalency Certificate authorizes NOVA Chemicals Corporation to handle,

offer for transport or transport and authorizes any person to handle or transport

on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods that are UN3393, Organometallic substance, solid, PYROPHORIC, WATER-REACTIVE (aluminum alkyls), Class 4.2(4.3), Packing Group I or UN3396, Organometallic substance, solid, water-reactive, flammable (aluminum alkyls), Class 4.3(4.1), Packing Group I, in a manner that does not comply with Packing Instruction 11 of the National Standard of Canada CAN/CGSB-43.146-2002, "Design, Manufacture and Use of Intermediate Bulk Containers for the Transportation of Dangerous Goods", January 2002, and subsection 5.12(1) of the Transportation of Dangerous Goods Regulations, if:

(a) the means of containment is an UN standardized means of containment;

(b) the means of containment is a Code 21A metal IBC rated for the Packing Group I level ("X" marking) as described in Sylvan Industry Inc., drawing 136‑801 filed by NOVA Chemicals Corporation, with the Transportation of Dangerous Goods Directorate for the purpose of this certificate;

CONDITIONS

(c) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(d) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 11098 (Ren. 4)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the certificate holder to transport UN3393, Organometallic substance, solid, PYROPHORIC, WATER-REACTIVE (aluminum alkyls), Class 4.2(4.3), Packing Group I orUN3396, Organometallic substance, solid, water-reactive, flammable (aluminum alkyls), Class 4.3(4.1), Packing Group I, in Code 21A metal IBCs.

The proposed IBC is a small means of containment (actual capacity of 450 L). These dangerous goods would be permitted in other small means of containment such as drums rated for the PG I. The proposed IBC is a pressure vessel that is much more robust than any standard drum rated for the PG I. The level of safety is maintained.
