CONDITIONS

This Equivalency Certificate authorizes Dyno Nobel Canada Inc., to handle, offer for transport or transport, by road vehicle, dangerous goods that are liquids of

Class 3, 5.1, 6.1, 8 or 9, with any or no subsidiary class and included in

Packing Group II or Packing Group III, in a manner that does not comply with subsections 5.1(1) and 5.12(1) of theTransportation of Dangerous Goods Regulations, with respect to the selection and use of means of containment, if:

(a) the means of containment containing the dangerous goods are permanently mounted on a vehicle or skid authorized as a Mobile Process Unit (MPU) designed to transport, manufacture and load explosives into boreholes in conformance with an explosives licence or certificate issued for the MPU under the Explosives Act and Explosives Regulations by the Minister of Natural Resources;

(b) the means of containment have a capacity less than or equal to 450 L;

(c) the means of containment are watertight and constructed so that neither rain nor road spray can come into contact with the dangerous goods, are leakproof and designed for the transport of liquids;

CONDITIONS

(d) the means of containment are of welded metal fabrication and constructed so that the dangerous goods are securely retained in the means of containment under normal conditions of transport and all the closures are closed during transport;

(e) the means of containment are constructed of impermeable, non-absorbent materials that will not be corroded by the lading;

(f) the means of containment are designed to facilitate cleaning and decontamination;

(g) the means of containment are capable of withstanding any internal pressure likely to be encountered under normal conditions of transport, without any permanent deformation or leaks;

(h) the means of containment are completely contained within the length and width of the vehicle or skid on which it is mounted;

(i) the Equivalency Certificate number "SH 11080" is visibly and legibly marked on the means of containment;

(j) the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(k) a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulations not specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate allows the transport of certain liquid dangerous goods included in Class 3, 5.1, 6.1, 8 or 9, in means of containment that are small tanks mounted permanently on a truck or skid, and is fitted with a large highway tank for explosive emulsion and that is licensed by the Explosives Regulatory Division (ERD) of Natural Resources Canada as a Mobile Process Unit (MPU). The small tanks are fitted with various discharge and return pipes and control valves that feed the liquid gassing and density control agents into a stream of non-sensitized emulsion for the purpose of manufacturing explosives. The process tanks are made of welded stainless steel and are significantly more robust than the minimum container required by the Transport of Dangerous Goods Regulations. UN Standardized containers are not practical as a substantial number of controls and openings not found on UN standardized containers are required for the operation of MPU as a licensed explosives manufacturing unit.
