CONDITIONS

This Equivalency Certificate authorizes Pointer Avionics Ltd., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods that are UN3091, LITHIUM METAL BATTERIES CONTAINED IN EQUIPMENT, Class 9, in a manner that does not comply with section 5.12 of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) each cell or battery have been determined to meet the criteria for assignment to Class 9 on the basis of tests carried out in accordance with the Recommendations on the Transport of Dangerous Goods - Manual of Tests and Criteria, Part III, subsection 38.3;

(b) the cells or batteries contained in equipment are transported in a strong outer means of containment constructed of suitable material, of adequate strength and design in relation to the packaging capacity, and its intended use. The means of containment shall be constructed in such a manner as to prevent accidental operation during transport;

CONDITIONS

(c) the cells or batteries shall be protected against short circuit;

(d) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 11035 (Ren. 2)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the certificate holder to transport four (4) D lithium metal cells contained inside the Emergency Locator Transmitter housing. The Emergency Locator Transmitter housing offers a very strong means of containment for the lithium metal cells. The Emergency Locator Transmitter has undergone extensive testing and is design to sustain plane crash situation. These means of containment offer an equivalent level of safety compared to the means of containment prescribed in Part 5 of the Transportation of Dangerous Goods Regulations. The conditions of this certificate reflect the requirements outlined in the latest edition of the UN Recommendations on the Transport of Dangerous Goods - Model Regulations.
