CONDITIONS

This Equivalency Certificate authorizes W.R. Grace & Co.-Conn to handle, offer for transport or transport and authorizes any person to handle, offer for transport or transport, in portable tanks, by road or railway vehicle, dangerous goods that are UN1838, TITANIUM TETRACHLORIDE, Class 6.1(8), Packing Group I, or UN3390, TOXIC BY INHALATION LIQUID, CORROSIVE, N.O.S.(Titanium Tetrachloride), Class 6.1(8), Packing Group I, in a manner that does not comply with subsection 5.1(1), subparagraph 5.14(1)(a)(ii) and 5.14(1)(b)(ii) of the Transportation of Dangerous Goods Regulations, if:

(a) the tanks are selected and used in accordance with CSA B621-09 "Selection and use of highway tanks, TC portable tanks, and other large containers for the transportation of dangerous goods, Classes 3, 4, 5, 6.1, 8, and 9", January 2009, except for specific requirement 19 of Clause 8.4 pertaining to insulation;

(b) the portable tanks are DOT 51 specification tanks manufactured of ASTM A516-GR70 carbon steel having a wall thickness equal to or greater than 12.5 mm (0.5 in.), a marked Maximum Allowable Working Pressure (MAWP) equal to or greater than 13.9 bar (200 psi) and a nominal water capacity equal to or less than 1628 L (430 US gal.);

CONDITIONS

(c) the tanks are transported inside a closed transport unit;

(d) drivers are trained and instructed to, when possible, move their vehicle away from the site of an accident involving fire or loss of flammable liquid, provided no lives will be endangered by moving the vehicle;

(e) the tanks are marked "SU 10962" on the long side with characters at least 50 mm high, and in a color contrasting to the background;

(f) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(g) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 10962 (Ren. 3)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the applicant to transport certain Class 6.1(8) products by road or railway vehicle in DOT 51 specification tanks that are not insulated. Non-insulated UN Standardized Portable Tanks of equal or lesser pressure rating are permitted for these dangerous goods.
