CONDITIONS

1. This Equivalency Certificate authorizes Neptec Design Group, to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by cargo aircraft, dangerous goods that are UN3480, LITHIUM ION BATTERIES, Class 9, Packing Group II, in accordance with Special Provisions A88 of the Technical Instructions for the Safe Transport of Dangerous Goods by Air, referenced in section 12.1 of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) each cell has been determined to meet the criteria for assignment to Class 9 on the basis of tests carried out in accordance with the Recommendations on the Transport of Dangerous Goods - Manual of Tests and Criteria, Part III, subsection 38.3;

(b) each battery or battery assembly has not been tested in accordance with the Recommendations on the Transport of Dangerous Goods - Manual of Tests and Criteria, Part III, subsection 38.3, and therefore, do not meet the inclusion criteria for Class 9;

(c) the mass of one battery assembly before being packaged in its outer packaging is less than or equal to 31 kg;

CONDITIONS

(d) each cell or battery incorporates a safety venting device or is designed to preclude a violent rupture under normal conditions of transport;

(e) each cell or battery is equipped with an effective means of preventing external short circuits;

(f) each battery containing cells or series of cells connected in parallel is equipped with effective means as necessary to prevent dangerous reverse current flow (e.g., diodes, fuses, etc.);

(g) the batteries are transported in an outer packaging that is a metal, plastic or plywood drum or a metal, plastic or wooden box and that meets the criteria for Packing Group I packagings;

(h) the batteries, which have a mass greater than 12 kg with a strong, impact resistant outer casing, are transported in strong outer packagings or protective enclosures (e.g., in fully enclosed or wooden slatted crates) or on pallets;

(i) the state of charge (SOC) of the battery must be less than or equal to 30% of the maximum capacity of the battery;

(j) a copy of this Equivalency Certificate accompanies the dangerous goods.

(k) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SA 10950 (Ren. 2)"

2. This Equivalency Certificate authorizes Neptec Design Group, to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by cargo aircraft, dangerous goods that are UN3171, BATTERY-POWERED VEHICLE, Class 9, in a manner that does not comply with column 12 of Table 3‑1, Dangerous Goods List, Chapter 2 of Part 3 of the Technical Instructions for the Safe Transport of Dangerous Goods by Air, referenced in section 12.1 of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the mass of all the batteries contained in the vehicle packaged in one outer packaging is less than or equal to 124 kg;

CONDITIONS

(b) the dangerous goods are transported in accordance with Packing Instructions 952 of the Technical Instructions for the Safe Transport of Dangerous Goods by Air, except that the each battery or battery assembly has not been tested in accordance with the Recommendations on the Transport of Dangerous Goods - Manual of Tests and Criteria, Part III, subsection 38.3, and therefore, do not meet the inclusion criteria for Class 9;

(c) the batteries are securely fastened in the vehicle, machinery or equipment and are protected in such a manner so as to prevent damage and short circuits;

(d) the state of charge (SOC) of the battery must be less than or equal to 30% of the maximum capacity of the battery;

(e) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SA 10950 (Ren. 2)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate is issued by the competent authority of Canada in accordance with special provisions A88 of the Technical Instructions for the Safe Transport of Dangerous Goods by Air.

This Equivalency Certificate also authorizes the transportation of UN3171, BATTERY-POWERED VEHICLE, Class 9, in accordance with Packing Instructions 952 of the Technical Instructions for the Safe Transport of Dangerous Goods by Air, except that the each battery or battery assembly has not been tested in accordance with the Recommendations on the Transport of Dangerous Goods - Manual of Tests and Criteria, Part III, subsection 38.3, and therefore, do not meet the inclusion criteria for Class 9.
