CONDITIONS

This Equivalency Certificate authorizes Chemtrade Logistics to handle, offer for transport or transport, and authorizes any person to handle or transport, on behalf of the certificate holder, in portable tanks, by road vehicle, dangerous goods that are UN1131, CARBON DISULFIDE, Class 3(6.1), Packing Group I, in a manner that does not comply with subsection 5.1(1) and subparagraph 5.14(1)(a)(ii) of the Transportation of Dangerous Goods Regulations, if:

(a) the tanks are selected and used in accordance with CSA Standard B621-09 "Selection and use of highway tanks, TC portable tanks, and other large containers for the transportation of dangerous goods, Classes 3, 4, 5, 6.1, 8,
and 9
", January 2009, as though they were TC51 portable tanks;

(b) the tanks meet the TC51 specification in CSA Standard B620-87 "Highway tanks and portable tanks for the transportation of dangerous goods", October 1987, and amended in February 1992, except that the tank working nozzles are grouped at mid tank on one side instead of on the top or one end of the tank as prescribed in CSA Standard B620-87;

(c) the tanks bear Clemmer Industries Limited serial numbers 5.974957, 5.974958, or 5.974959;

CONDITIONS

(d) the maximum allowable working pressure and set to discharge pressure of the pressure relief devices are at least 3447 kPa (500 psig);

(e) the tanks are marked with the Equivalency Certificate number "SH10897" on each long side of the tank with characters at least 50 mm high and in a color contrasting to the background; and

(f) despite the periodic inspection frequencies in Table 7.1 of CSA Standard B620‑09 "Highway tanks and TC portable tanks for the transportation of dangerous goods", January 2009, and referred to in Clause 6.3.1 of CSA Standard B621‑09 "Selection and use of highway tanks, TC portable tanks, and other large containers for the transportation of dangerous goods, Classes 3, 4, 5, 6.1, 8, and 9", January 2009, the tanks shall be inspected and tested in accordance with requirements for TC331 tanks.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the transportation of UN1131, CARBON DISULFIDE, Class 3(6.1), Packing Group I, in existing non-spec tanks that meet the requirements of the TC51 specification except that the valves and fittings are located on the side instead of the front or top of the tank. The inspection and test frequencies are revised to match the frequencies of tanks that would typically be used to deliver this product.
