CONDITIONS

1. This Equivalency Certificate authorizes SodaStream Industries Ltd.,to sell, offer for sale, distribute or deliver in Canada, and authorizes any person to handle, offer for transport, transport or import, by road or railway vehicle, by aircraft or by ship, cylinders in a manner that does not comply with subparagraphs 5.10(1)(a)(i), 5.10(1)(b)(i), paragraph 5.10(1)(c), subparagraph 5.10(1)(d)(i), and subsection 5.10(2) of the Transportation of Dangerous Goods Regulations, if:

Selection and Use

(a) the requirements applicable to Specification TC-3ALM cylinders in National Standard of Canada CAN/CSA B340-02, "Selection and Use of Cylinders, Spheres, Tubes, and Other Containers for the Transportation of Dangerous Goods, Class 2", October 2002, as amended in January 2004 and February 2005 are complied with;

Manufacture and Requalification

(b) the cylinders are manufactured at Mishor Adumim Plant, Ugda Street 50, Mishor Adumim Industrial Zone, Jerusalem, Israel, in accordance with the specific designs, procedures, and drawing numbers D134501 or D134601, filed by SodaStream Industries Ltd., with the Director, Regulatory Affairs Branch, Transport Dangerous Goods Directorate, Transport Canada;

CONDITIONS

(c) subject to conditions (d) to (g) of this certificate, the cylinders are in conformity with the applicable requirements for specification TC-3ALM set out in National Standard of Canada CAN/CSA B339-02, "Cylinders, Spheres, and Tubes for the Transportation of Dangerous Goods", October 2002, as amended in November 2003 and February 2005, cited in the rest of this certificate as CAN/CSA B339-02;

(d) the service pressure of the cylinders is 124 bar;

(e) the wall thickness of the cylinders is not less than 2.7 mm;

(f) the outside diameter of the cylinders does not exceed 90.50 mm;

(g) despite Clause 4.12.1 of CAN/CSA B339-02, the hydrostatic test with volumetric expansion measurement prescribed for cylinder manufacture and requalification may be performed by SodaStream Industries Ltd., with the ALPHA II TQC Cylinder Test Pressure Machine, subject to the following requirements:

(i) the test method is in accordance with the ALPHA II TQC Operation Manual, filed by SodaStream Industries Ltd., with the Director, Regulatory Affairs Branch,Transport Dangerous Goods Directorate, Transport Canada,
on June 8, 2012,

(ii) each test is witnessed by an independent inspector who is registered in accordance with Clause 25.4 of CAN/CSA B339-02,

(iii)the verification of the accuracy of the test equipment is recorded on a report form, the format of which contains at a minimum all the information shown in sample form "Test apparatus calibration verification data for water jacket volumetric expansion testing" in Appendix D of Compressed Gas Association Inc., Publication C-1, Methods for Pressure Testing of Compressed Gas Cylinders, cited in the rest of this certificate as CGA C-1-2009, and

(iv)each test is recorded on a report form, the format of which contains at a minimum all the information shown in sample form "Requalification data sheet" in Appendix D of CGA C-1-2009, except for the rejection elastic expansion (REE).

2. This Equivalency Certificate serves as the registration of SodaStream Industries Ltd.,in accordance with Clauses 25.2 and 25.3 of CAN/CSA B339-02, to manufacture and requalify cylinders as specified herein. SodaStream Industries Ltd.'s registered mark is:

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations not specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes SodaStream Industries Ltd., to test the cylinders it manufactures and requalifies using the ALPHA II TQC Test Pressure Machine. The certificate holder has demonstrated that cylinders tested with the machine could be used with a level of safety equivalent to those tested hydrostatically by the methods required by the Transportation of Dangerous Goods Regulations.

NOTE

Under Canadian Law, a foreign manufacturer of non-specification cylinders cannot be charged with an offence under the Transportation of Dangerous Goods Act, 1992 for failure to comply with the conditions of an Equivalency Certificate. However, certain remedies under the Act are available to Transport Canada in this eventuality.

These include:

1. detention of dangerous goods and consequently the means of containment containing them (subsection 17(1));

2. detention of the means of containment whether full or empty (subsection 17(1));

3. directions not to import the means of containment or to return them to origin (subsection 17(3));

4. inspectors' directions (section 19);

5. directions to importers of the means of containment to issue notices of defective construction or recall (subsection 9(2)); and

6. revocation of the certificate, thereby making any use of the means of containment an offence (subsection 31(6)).

If none of the foregoing are adequate, Protective Directions may be issued to prohibit or to control the use of the means of containment (section 32).
