This Equivalency Certificate authorizes NOVA Chemicals Corporation to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road vehicle, dangerous goods that are UN3167, GAS SAMPLES, NON-PRESSURIZED, FLAMMABLE, N.O.S., not refrigerated liquid, Class 2.1, in a manner that does not comply with subsection 5.1(1), subparagraph 5.10(1)(a)(ii), and subsection 5.10(2) of the Transportation of Dangerous Goods Regulations, if:

(a) the dangerous goods are flare gas samples primarily composed of nitrogen and ethylene;

(b) the dangerous goods are in transport for the purposes of analyzing or testing;

(c) the dangerous goods are transported from the certificate holder's facility in Corunna or St. Clair River, Ontario, Canada, to ORTECH Environmental, a division of ORTECH Consulting, Inc., Mississauga, Ontario, Canada;

(d) the dangerous goods are transported at a pressure corresponding to ambient atmospheric pressure at the time the means of containment is closed and does not exceed an absolute pressure of 105 kPa;

(e) the dangerous goods are handled, offered for transport or transported in a means of containment that is a combination packaging comprising of an inner packaging in a hermetically sealed metal intermediate packaging and a

UN code 1A1, 1A2, 1B1, 1B2, 1N1, 1N2, 1H1, 1H2, 1D, 1G, 3A1, 3A2, 3B1, 3B2, 3H1, 3H2, 4A, 4B, 4N, 4C1, 4C2, 4D, 4F, 4G, 4H1, or 4H2 outer packaging;

(f) the inner packaging is a Tedlar® gas sampling bag with a capacity not greater than 5 L, as described by the certificate holder in their application on file with the Chief, Permits and Approvals Division, Regulatory Affairs Branch, Transport Dangerous Goods Directorate, Transport Canada;

(g) the combination packaging as prepared for transport is capable of meeting the test requirements specified in chapter 7 of Transport Canada Standard

TP 14850E, "Small Containers for Transport of Dangerous Goods, Classes 3, 4, 5, 6.1, 8 and 9, a Transport Canada Standard", 2nd Edition, October 2010, published by Transport Canada, to the Packing Group I or II performance level; and

(h) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SH 10873 (Ren. 1)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the transport of non-pressurized, flammable gas samples in a means of containment that is not manufactured, selected, and used in accordance with a safety standard prescribed in Part 5 of the Transportation of Dangerous Goods Regulations. The conditions of this Equivalency Certificate are aligned with the provisions of the "Recommendations on the Transport of Dangerous Goods", Seventeenth revised edition, 2011, published by the United Nations, which authorize the transport of the dangerous goods specified herein in combination packagings as an alternative to gas cylinders.
