CONDITIONS

This Equivalency Certificate authorizes GFL Environmental Inc., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road vehicle, dangerous goods that are paints or paint related materials contaminated with polychlorinated biphenyls (concentration over 50 ppm), in a manner that does not comply with Part 2, except section 2.2.1 of the Transportation of Dangerous Goods Regulations, if:

(a) the dangerous goods are classified as:

(i) the shipping name "PAINT or PAINT RELATED MATERIALS",

(ii) the classification "3",

(iii) the product identification number "UN1263", and

(iv) the packing group "II" or "III";

CONDITIONS

(b) the means of containment containing the dangerous goods is marked with the following information legibly and indelibly printed:

"Contains POLYCHLORINATED BIPHENYLS (PCB)";

(c) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate; and

(d) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

(i) "Equivalency Certificate No. SH 10727 (Ren. 3)", and

(ii)"Contains POLYCHLORINATED BIPHENYLS (PCB) in concentration over 50 ppm".

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.
