CONDITIONS

This Equivalency Certificate authorizes Orica Canada Inc., to handle, offer for transport or transport, by cargo aircraft operated under Subpart 2 or 3 of Part VII of the Canadian Aviation Regulations, dangerous goods in a manner that does not comply with subsection 12.1(2) of the Transportation of Dangerous Goods Regulations, if:

(a) the dangerous goods transported are in direct support of mining operations and activities;

(b) the dangerous goods are handled, offered for transport or transported from the last aerodrome of departure to the mining operations base in compliance with section 12.12 - Aerial Work of the Transportation of Dangerous Goods Regulations, except for subsection 12.12(1);

(c) the dangerous goods are not forbidden for air transport as per Table 3-1 of Chapter 2 of Part 3 of the Technical Instructions for the Safe Transport of Dangerous Goods by Air;

(d) the dangerous goods are handled, offered for transport or transported to the last aerodrome of departure in compliance with the Transportation of Dangerous Goods Regulations;

CONDITIONS

(e) in the case the dangerous goods to be transported do not meet sub-
section 12.12(2) of the Transportation of Dangerous Goods Regulations, they are contained in a means of containment that is a UN13H2 or UN13H3 Flexible Intermediate Bulk Container;

(f) the maximum net quantity of the dangerous goods per Flexible Intermediate Bulk Container does not exceed 1000 kg;

(g) the dangerous goods are loaded aboard the cargo aircraft or as an external load at the last aerodrome of departure to access the geographical area where the dangerous goods will be used in support of mining operations and activities and no stops are permitted at any other aerodrome except for emergency reasons or re-fuelling;

(h) the certificate holder ensures that the personnel handling and transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate and a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the certificate holder to handle, offer for transport or transport, by cargo aircraft, dangerous goods to mine sites in compliance with section 12.12 - Aerial Work of the Transportation of Dangerous Goods Regulations. The certificate also authorizes the transportation of dangerous goods in large means of containment that are UN13H2 or UN13H3 Flexible Intermediate Bulk Containers. The use of Flexible Intermediate Bulk Containers is not allowed under subsection 12.12(2) of the Transportation of Dangerous Goods Regulations.
