CONDITIONS

This Equivalency Certificate authorizes Armand H. Couture Ltd., to handle, offer for transport or transport and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods that are Diesel FUEL, Class 3, UN1202, Packing Group III; Gasoline, Class 3, UN1203, Packing Group II; KEROSENE, Class 3, UN1223, Packing Group III or Fuel, Aviation, Turbine Engine, Class 3, UN1863, Packing Group III, in a Mobile Intermediate Bulk Container (IBC) in a manner that does not comply with Clause 13.1.5(c) (Selection and Use) of National Standard of Canada CAN/CGSB-43.146‑2002, "Design, Manufacture and Use of Intermediate Bulk Containers For the Transportation of Dangerous Goods", January 2002, cited in the rest of this certificate as CAN/CGSB‑43.146‑2002, included by reference in subsections 5.12(1) and 5.14(1) of the Transportation of Dangerous Goods Regulations, if:

(a) the mobile IBC is a ULC Standard mobile refuelling tank manufactured before January 1, 2003;

CONDITIONS

(b) the mobile IBC conforms with the requirements of ULC ORD-C142.13-1997;

(c) the manufacturer of the mobile IBC was listed with a product certification organization accredited or recognized by the Standards Council of Canada; and

(d) the Mobile IBC is legibly and indelibly marked with the Equivalency Certificate number "SU 10375".

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations not specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the certificate holder to transport certain flammable liquids in ULC ORD-C142.13-1997 "Mobile Refuelling Tanks" beyond the sunset date set out in the CAN/CGSB-43.146-2002 standard. These tanks are subjected to the inspection and test requirements applicable to UN Standardized Mobile IBCs, including the requirements for re-inspection every 60 months in accordance with Appendix C of CAN/CGSB-43.146-2002.
