This Equivalency Certificate authorizes Siltech Corporation to handle, offer for transport or transport, and authorizes any person to handle or transport, on behalf of the certificate holder, by road or railway vehicle, dangerous goods that are UN2988, CHLOROSILANES, WATER-REACTIVE, FLAMMABLE, CORROSIVE, N.O.S. (Dimethylchlorosilane), Class 4.3(3)(8), Packing Group I, in a manner that does not comply with Special Provision 38 of the Transportation of Dangerous Goods Regulations, if:

(a) the means of containment complies with the requirements set out in Part 5 of the Transportation of Dangerous Goods Regulations;

(b) the maximum capacity of the means of containment is 24 000 L;

(c) the contents of the portable tanks are maintained under a nitrogen gas atmosphere for all loading and unloading operations to ensure the integrity of the portable tank;

(d) the components of the portable tanks such as liquid and vapour valves along with gaskets are proven compatible with the product transported;

(e) the portable tanks are inspected prior to each loading, unloading and shipment;

(f) the maximum degree of filling shall be in accordance with the Portable Tank Special Provision TP2 in CSA Standard B625-08, "Portable tanks for the transport of dangerous goods", July 2008;

(g) an Emergency Response Assistance Plan (ERAP), as required by Part 7

of the Transportation of Dangerous Goods Regulations, is submitted and approved by the Transport of Dangerous Goods Directorate before any consignment is transported; and

(h) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(i) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 10093 (Ren. 3)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

Under the UN Recommendations on the Transport of Dangerous Goods,
UN2988, Chlorosilanes, Water Reactive, Flammable, Corrosive n.o.s, Class 4.3(3)(8), are currently authorized for transport in bulk using IMO Type 1 containers. Harmonization of the Transportation of Dangerous Goods Regulations with the UN Recommendations is expected to take place in an upcoming amendment.
