CONDITIONS

This Equivalency Certificate authorizes Axalta Coating Systems Canada Companyto handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road vehicle, dangerous goods that are residues of UN1263, Paint or Paint Related Material, Class 3, Packing Groups II or III, UN1866, Resin Solution, flammable, Class 3, Packing Groups II or III, UN1993, Flammable Liquid, n.o.s., Class 3, Packing Groups II or III, or UN3082, ENVIRONMENTALLY HAZARDOUS SUBSTANCE, LIQUID, N.O.S., Class 9, Packing Group III, contained in Intermediate Bulk Containers (IBC) in a manner that does not comply with paragraph 5.2(b) and subparagraph 5.14(1)(a)(i) of the Transportation of Dangerous Goods Regulations, if:

(a) the capacity of each IBC does not exceed 2 200 L and the residues of the dangerous goods in the IBC's do not exceed 10 per cent of the IBC's capacity;

(b) a leaking IBC is rendered leak proof by applying a high-performance lined aluminum foil self-adhesive tape and anti-static plastic wrap;

(c) the IBC is being transported directly from Axalta Coating Systems Canada Company to a facility to be cleaned;

CONDITIONS

(d) the IBC is being transported in a dedicated means of transport that is vented to avoid the accumulation of flammable gas;

(e) the road vehicle used to transport the IBC has placards displayed on it in accordance with Part 4 of the Transportation of Dangerous Goods Regulations;

(f) after the IBC is cleaned and repaired, and prior to refilling the IBC with dangerous goods, the IBC is transported to a qualified IBC Leak Test & Inspection Facility for inspection and testing in accordance with Appendix C

of the National Standard of Canada CAN/CGSB-43.146-02, "Design, Manufacture and Use of Intermediate Bulk Containers for the Transportation of Dangerous Goods", January 2002;

(g) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(h) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SH 10032 (Ren. 4)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes Axalta Coating Systems Canada Company to transport Intermediate Bulk Containers, which still contain residue of Class 3 or Class 9 material and which, due to apparent damage or wear, are compromised from meeting original packaging specification or standard. The IBCs are transported directly to a facility to be cleaned and purged. After the IBCs are cleaned and repaired and prior to refilling the IBCs with dangerous goods, the IBCs are transported to a qualified IBC Leak Test & Inspection Facility for inspection and testing in accordance with Appendix C of the National Standard of Canada CAN/CGSB-43.146-02, "Design, Manufacture and Use of Intermediate Bulk Containers for the Transportation of Dangerous Goods", January 2002.
