CONDITIONS

This Equivalency Certificate authorizes Ultra Electronics Maritime Systems Inc., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicles, or by ship on a domestic voyage, dangerous goods that are UN3091, LITHIUM METAL BATTERIES CONTAINED IN EQUIPMENT, Class 9, contained in a sonobuoy, in a manner that does not comply with subsection 5.1(1) and section 5.12 of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) each cell or battery has been determined to meet the criteria for assignment to Class 9 on the basis of tests carried out in accordance with the Recommendations on the Transport of Dangerous Goods - Manual of Tests and Criteria, Part III, subsection 38.3;

(b) the dangerous goods are contained within the aluminum body of the sonobuoy described by drawings no. 200896, 200898, 200702, 200671, 200836, and 200837 described in documents submitted by Ultra Electronics Maritime Systems Inc., and kept on the certificate file;

CONDITIONS

(c) the sonobuoy is packaged in the military performance specification plastic shipping container type CNU-239/E specified in the drawing 012-159-0009-00 described in documents submitted by Ultra Electronics Maritime Systems Inc., and kept on the certificate file;

(d) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(e) the shipping document that accompanies the dangerous includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 0850 (Ren. 19)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

The sonobuoys authorized for use in this certificate are a sturdy aluminum assembly subjected to stringent military specifications that exceed

the requirements for UN Standardized packaging. The sonobuoys are further packaged for transport in a plastic container that has passed the UN packaging qualification test at the Packing Group II level of performance.

Packing Instruction 903 of the Transport Canada Standard TP14850 is presently being revised to include batteries contained in equipment at which time this Equivalency Certificate will no longer be required.
