CONDITIONS

This Equivalency Certificate authorizes Dow AgroSciences Canada Inc., to handle, offer for transport or transport, by road or railway vehicle, dangerous goods in a manner that does not comply with Part 2 (Classification), Part 3 (Documentation), Part 4 (Dangerous Goods Safety Marks), Part 5 (Means of Containment), and Part 7 (Emergency Response Assistance Plan) of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the dangerous goods are experimental and commercial products that are regulated under the Pest Control Products Act;

(b) the dangerous goods are in transport for the purposes of classifying, analysing or testing;

(c) the dangerous goods are believed not to contain explosives, infectious substances or radioactive materials;

(d) the dangerous goods are contained in inner means of containment that are surrounded by an absorbent cushioning material and are secured to prevent their movement inside an outer means of containment;

CONDITIONS

(e) the outer means of containment is either an aluminum box or a wooden box that is constructed of plywood no less than 6.35 mm (¼") thick; and

(i) has a lockable lid,

(ii) is marked with:

(A)the words "Pesticides - Test Samples",

(B)a 24-hour emergency telephone number,

(iii) contains a maximum net mass of 30 kg of dangerous goods or a maximum net volume of 30 L of dangerous goods;

(f) the gross quantity of the dangerous goods being transported in a vehicle does not exceed 500 kg;

(g) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(h) the dangerous goods are accompanied by a document, which include the following information legibly and indelibly printed:

(i) "Pesticides - Test Samples",

(ii) a 24-hour emergency telephone number,

(iii) "Equivalency Certificate No. SU 0727 (Ren. 16)".

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

The applicant employs a staff of up to 10 research officers who carry out field-testing of experimental and commercial insecticides and herbicides to satisfy requirements for registration under the Pest Control Products Act. These research officers must carry their equipment to the test sites. The applicant proposes to use specially designed aluminum or wooden boxes as the outer means of containment. These boxes will be lined with a cushioning material for absorbent purposes and will have interchangeable inserts to accommodate the various inner means of containment.
